Special City Council Minutes - 07/31/03 <br />Page 9 <br />available until the regular Council meeting on Monday, <br />July 31, 2003 . <br />Councilmember Maschka questioned the urgency for a <br />decision at tonight's meeting. <br />Councilmember Schroeder alleged that Councilmember <br />Maschka was apparently trying the case again, and while <br />he might need to do so for his decision-making process, it <br />was not pertinent to tonight's discussion, and that the legal <br />issues had been determined and the Council and City <br />could move forward. <br />At this point, Mayor Kysylyczyn attempted to join in the <br />discussion to make a recommendation on behalf of <br />Councilmember Schroeder to the City Attorney. <br />Councilmember Maschka questioned if the Council <br />weren't in violation of law with Mayor Kysylyczyn <br />attempting to participate in the discussion, given his <br />obvious status as a pecuniary interested party. <br />The Chair refused to recognize Mayor Kysylyczyn as a <br />participant in the discussion. <br />Another attempt was made by Mayor Kysylyczyn to <br />address the City Attorney at the bench; at which point, <br />City Attorney Anderson recommended that Chair Kough <br />call for a recess. <br />Recess Recess <br />Acting Mayor Kough recessed the meeting at 7:39 p.m. <br />and reconvened the meeting at 8:01 p.m. <br />Upon reconvening the meeting, Acting Mayor Kough <br />requested that City Attorney Anderson summarize <br />discussions held between Councilmember Kough, Mayor <br />Kysylyczyn and City Attorney Anderson during the recess <br />and outside the Council Chambers. <br />
