Payment of Legal Fees for Actions Taken While <br />Performing Duties as Mayor/City Councilmember <br />Acting Mayor Kough stated the purpose of the special <br />meeting of the Roseville City Council as stated above. <br />Acting Mayor Kough reviewed the topic before the <br />Council; legal opinion and supporting documentation from <br />City Attorney Scott Anderson; and requested City <br />Attorney Anderson provide a surr~nzary and review of his <br />research of this matter and subsequent recommendations <br />via his firm's legal opinion as City Attorney to the <br />Roseville City Council as they individually and <br />corporately considered their decision-making process. <br />City Attorney Anderson introduced his research of the <br />broad issue regarding reimbursement for expenses <br />associated with the defense of a criminal matter by an <br />employee or officer of a city, as instructed by the City <br />Council at a previous meeting; prompted by criminal <br />charges that had been brought against Mayor Kysylyczyn <br />in his capacity as Mayor of the City of Roseville. Mr. <br />Anderson further advised that he had received specific <br />questions individually from Councilmember Schroeder <br />relating to the issue and City Code, Chapter 105. <br />Mr. Anderson briefly reviewed the supporting <br />documentation researched and provided in the Council <br />Agenda Packet materials, including a legal opinion <br />prepared by attorneys Scott T. Anderson, Jay T. Squires <br />and Eric L. Hedtke of the City Attorney's firm of Ratwik, <br />Roszak & Maloney, and dated July 27, 2003.
