City Attorney Anderson responded negatively; allowing that each Councilmember was entitled to counsel with him privately, but that this discussion and subsequent decision met no cause for Closed Executive Session under Open Meeting Law constraints. Mr. Anderson also cautioned consideration of "serial" meetings to circumvent Open Meeting Law requirements in an effort to avoid public discussion of the matter. Councilmember Schroeder expressed appreciation to City Attorney Anderson for the information provided and advised that the information had clarified the process and subsequent action required of the Council. Councilmember Schroeder presented as a bench handout an itemized request dated July 31, 2003, addressed to the City Council from Mayor Kysylyczyn for reimbursement of $17,802.91 under Minnesota Statutes § 465.76. Schroeder moved to approve the written request for payment of the mayor's legal bill in the amount of $17,802.91 under Minnesota Statute § 465.76; the bill being properly itemized and detailed; and that the fees and reimbursement are considered reasonable under the facts and circumstances; noting that the case was dismissed by a Ramsey County District Court judge; and having reviewed the City Attorney's opinion dated July 27, 2003. Acting Mayor Kough expressed concern with making a determination at tonight's meeting, given that the bill had just been received, and no review had been provided by the City Attorney. As no second was forthcoming to his motion, Councilmember Schroeder requested a recess to allow the City Attorney to review the bill, at which time the meeting could be reconvened.
