Special City Council Minutes - 07/31/03 <br />Page 7 <br />on whether this discussion should be held in closed <br />Executive Session. <br />City Attorney Anderson responded negatively; allowing <br />that each Councilmember was entitled to counsel with him <br />privately, but that this discussion and subsequent decision <br />met no cause for Closed Executive Session under Open <br />Meeting Law constraints. Mr. Anderson also cautioned <br />consideration of "serial" meetings to circumvent Open <br />Meeting Law requirements in an effort to avoid public <br />discussion of the matter. <br />Councilmember Schroeder expressed appreciation to City <br />Attorney Anderson for the information provided and <br />advised that the information had clarified the process and <br />subsequent action required of the Council. <br />Councilmember Schroeder presented as a bench handout <br />an itemized request dated July 31, 2003, addressed to the <br />City Council from Mayor Kysylyczyn for reimbursement <br />of $17,802.91 under Minnesota Statutes § 465.76. <br />Schroeder moved to approve the written request for <br />payment of the mayor's legal bill in the amount of <br />$17,802.91 under Minnesota Statute § 465.76; the bill <br />being properly itemized and detailed; and that the fees <br />and reimbursement are considered reasonable under <br />the facts and circumstances; noting that the case was <br />dismissed by a Ramsey County District Court judge; <br />and having reviewed the City Attorney's opinion dated <br />July 27, 2003. <br />Acting Mayor Kough expressed concern with making a <br />determination at tonight's meeting, given that the bill had <br />just been received, and no review had been provided by <br />the City Attorney. <br />As no second was forthcoming to his motion, <br />Councilmember Schroeder requested a recess to allow the <br />City Attorney to review the bill, at which time the meeting <br />could be reconvened. <br />
