Special City Council Minutes - 07/31/03 <br />Page 8 <br />Acting Mayor Kough opined that, upon City Attorney <br />review to determine if the billing was reasonable, he may <br />be prepared to concur with Councilmember Schroeder and <br />offer a second to the motion. <br />City Attorney Anderson sought and received recognition <br />by the Chair and stated that, due to the nature of the <br />meeting and the process allowed for consultation with <br />legal counsel, he reconllnended that the motion be <br />modified by its maker to provide that approval of the <br />reimbursement request was subject to approval of the City <br />Attorney as to the reasonableness of the request, affording <br />him time to review the bill, research similar fee ranges, <br />contact others for their expertise regarding the billing; and <br />to report his findings to the Council prior to approval. <br />'The motion was amended by Schroeder as <br />recommended by City Attorney Anderson to include <br />terminology that payment be subject to a pending <br />review and approval by the City Attorney as to the <br />reasonableness of the itemized billing. Councilmember <br />Schroeder acknowledged that the motion still was in <br />need of a second. <br />Acting Mayor Kough opined that he would prefer to call a <br />brief recess for private consultation with the City <br />Attorney, prior to his consideration of a second. <br />Councilmember Maschka advised that he was in no <br />position to move ahead on this issue until he received <br />additional information as to the legal counsel provided to <br />Mayor Kysylyczyn by the former City Attorney; and <br />expressed disappointment at the methodology used to call <br />this special Council meeting, without a full Council <br />available; and recommended a continuance. <br />Acting Mayor Kough defended the circumstances <br />surrounding calling the special Council meeting, following <br />his conversations with Councilmember Schroeder, at <br />which time he concurred with him on Saturday, with the <br />special meeting called on Sunday, and their lack of <br />
