Further discussion included ponding issues on site and ensuing cooperation of the Rice Creek Watershed District; realignment of streets; State Aid identified streets; cooperation and consideration of Ramsey County to the project and their involvement in preliminary discussions; realignment of islands and turn movements; and semaphore at HarMar and utilizing it more effectively for traffic management. Mayor Kysylyczyn concurred with those comments and concerns of Councilmembers; clarified street load ratings for area streets with Mr. Welsch; supported enforcement of nuisance ordinances related to vehicle noise as required; and supported the drafting of a Memorandum of Understanding (MOU) to begin to identify certain areas of responsibility and required action. Kysylyczyn moved, Schroeder seconded, directing staff to draft a Memorandum of Understanding (MOU) regarding this proposed development for Council review at a future meeting. Mr. Welsch accepted the Council direction in drafting the MOU and identified the proposed substance, without specific; stating that the MOU being brought before the Council prior to moving forward with the Public Hearing process for land use. Mr. Welsch advised that staff would await Council direction for the final MOU, following their review of the draft MOU, and reminded Councilmembers that the MOU served as a non-binding agreement and was subject to revision, simply serving as a guideline for all parties. Councilmember Klausing requested adequate time to review and digest the document prior to making a bench decision.
