Regular City Council Minutes - 8/18/03 <br />Page 13 <br />Councilmember Maschka opined his concern regarding <br />on-site ponding and potential need for an environmental <br />impact statement (EIS) or Environmental Assessment <br />Worksheet (EAW) to determine impacts to adjoining <br />property. <br />Mr. Paschke attempted to respond to concerns expressed <br />by Councilmember Maschka and Councilmember <br />Klausing respectively, related to environmental impact <br />related to city code and state mandates; and the factors <br />staff used in making a determination that there was no <br />significant environmental impact. <br />City Attorney Scott Anderson summarized the areas of <br />city code and state statute addressing environmental <br />impacts and whether the City could determine whether an <br />environmental assessment was required. <br />Councilmember Maschka reiterated his concern with the <br />project's density and location adjacent to an <br />environmentally sensitive area; opining that an EAW or <br />EIS would seem appropriate, along with a reduction in <br />density, given the slope of the land. Councilmember <br />Maschka further opined that the project needed further <br />review. <br />Councilmember Kough concurred that, due to the location <br />of the project next to the Nature Center, it presented a <br />unique concern; but opined that the Planning Commission <br />had apparently done sufficient research into the project <br />since they unanimously recommended approval. <br />Councilmember Kough expressed his encouragement for <br />private development within the City. <br />Councilmember Maschka opined that, as a policy maker, <br />this concept is too intense for this particular location. <br />Mayor Kysylyczyn advised that citizen advisory <br />commissions exist to provide advice; but that the role of <br />the City Council was to be the decision-makers, and the <br />comments raised questions that may cause more concern. <br />
