Regular City Council Minutes - 8/18/03 <br />Page 29 <br />Kysylyczyn moved, Kough seconded, to direct staff to <br />proceed with Request for Proposals (RFP's) for a three tier <br />program (single, single plus one, and family); and to <br />further direct staff to bring back a plan for consideration <br />and conllnent on how to phase-in a uniform cafeteria <br />system. <br />Roll Call <br />Ayes: Klausing, Schroeder, Kough, Maschka and <br />Kysylyczyn. <br />Nays: None. <br />C. City Payment of a Portion of an Employee's Health <br />Insurance Premiums <br />Human Resources Director Eldona Bacon advised that <br />previous issues had been resolved in conversations with <br />Preferred One and their legal Counsel, with them opining <br />that the City was obligated to abide by the COBRA laws, <br />and directly to COBRA laws, with the amount paid and <br />extension of payment period not being longer than <br />provided for by state statute. <br />Discussion among Councilmembers, Ms. Bacon and City <br />Attorney Anderson included past and current city practice; <br />interpretations of employee status related to receipt of <br />insurance coverage; Family Medical Leave Act (FMLA) <br />considerations; potential litigation issues; <br />Kysylyczyn moved, Schroeder seconded, Option One as <br />previously outlined by City Attorney Anderson: <br />"For employees suffering from a disability as that term is <br />defined by the Americans With Disabilities Act (ADA), <br />[who have also qualified for disability benefits under the <br />city's [or other] long or short term disability insurance <br />plan] the city may, at its sole discretion, continue to pay <br />the city's portion of [single] [family] [health] [life] <br />[and/or] [dental] insurance premiums under the city's <br />group [health] [life] [andlor] [dental] insurance plan(s) for <br />up to one year after the employee is unable to work due to <br />the disabling condition." <br />City Payment of a <br />Portion of an <br />Employee's Health <br />Insurance <br />Premiums <br />"The city will require verification from a physician that <br />
