<br />Regular City Council Minutes -10/20/03 <br />Page 24 <br /> <br />Prior to his review of this alleged situation, Mayor <br />Kysylyczyn addressed several other issues, advising that <br />he would have written complaints to bring forward at a <br />future n1eeting on these issues as well (i.e., Allina's <br />proposed development and the City's issuance of <br />Industrial Revenue bonds; and alleged misrepresentation <br />by staff of recycling data). <br /> <br />Councilnlember Klausing questioned Mayor Kysylyczyn <br />as to whether he had discussed these concerns with City <br />Manager Beets prior to their presentation at a public <br />Council nleeting. <br /> <br />Mayor Kysylyczyn advised that he was bringing the issue <br />forward directly to the City Council in a public forum, in <br /> <br />f'f' , , ,."1 . , ."1. "1 <br />an errort to ensure to tne communIty tnat people can <br />conunent on issues without expectation of repercussion. <br /> <br />Councilnlenlber Klausing took issue with Mayor <br />Kysylyczyn's interpretation and editorial comment on the <br />written nlaterial presented; opining that it would have been <br />procedurally appropriate to bring the items to City <br />Manager Beets for his initial investigation in his role as <br />City Manager. <br /> <br />City Attorney Anderson spoke to the role of City <br />Councilnlenlbers and the City Attorney, opining that the <br />conlplaint should have appropriately been forwarded <br />directly to the City Manager for his determination if an <br />investigation was warranted; with a copy provided to <br />Councihnenlbers for their information, put not addressed <br />in a public fornnl. City Attorney Anderson further <br />addressed the itenls presented and the public versus <br />private data involved. <br /> <br />Councilnlember IZlausing responded that, in light of the <br />conUllents of City Attorney Anderson, the item should be <br />refen"ed to City Manager Beets for his review and a <br />detennination as to whether an investigation was required. <br />
