Staff also copied and distributed <br />copies of e-mails received to-date on the subject. <br /> <br />Councilmember Maschka requested that City Attorney <br />Squires provide legal opinion prior to Council discussion. <br /> <br />City Attorney Squires summarized the legal opinion dated <br />November 12, 2003 related to filling Council vacancies, in <br />consideration of the vacancy created when <br />Councilmember Klausing assumes his elected position of <br />Mayor after January 1, 2004 with less then two years <br />remaining on his existing Council term. <br /> <br />City Attorney Squires reviewed state statute related to <br />timing of appointments and/or special elections and <br />options available within the scope of the City Council <br />directive and several scenarios related to candidate filing <br />and public notification and Council declaration of the <br />vacancy. <br /> <br />Councilmen1ber Maschka requested additional information <br />as to accessibility issues; with City Attorney Squires <br />responding to practical issues related to poll accessibility <br />and timing related to voter turnout expectations. <br /> <br />Councilmember Kough cited a sample City of Richfield <br />ordinance, but City Attorney Squires pointed out that this <br />city was a Charter City and would be under different <br />statutory requirements that the City of Roseville. <br /> <br />City Attorney Squires advised that whether or not a <br />Primary was held for a Special Election was optional at <br />the discretion of the City Council and resident preference. <br /> <br />Mayor Kysylyczyn sought clarification from City <br />Attorney Squires related to the candidate filing period not <br />allowed less than 14 days after the declared vacancy; with <br />City Attorney Squires requesting further research of that <br />issue if that period were abbreviated or deviated from. <br /> <br />Further discussion ensued regarding reducing length of <br />
