<br />City Council Regular Meeting - 04/10/06 <br />Minutes - Page 11 <br /> <br />simply be incorporating the two in a broader visioning <br />process. <br /> <br />Mayor Klausing sought clarification from City <br />Attorney Scott Anderson regarding whether or not a <br />Truth in Taxation issue was evident with the City's <br />use of HRA funds as outlined; with City Attorney <br />Anderson responding that there was not an issue. <br /> <br />Roll Call <br />Ayes: Maschka; Pust and Klausing. <br />Nays: Ihlan and Kough. <br /> <br />Approve Request of Speedway SuperAmerica for a <br />Conditional Use Permit Amendment, 2295 Rice <br />Street (PF 3711) (Former Consent Item 3.g) <br />At the request of :rv1ayor Klausing, City Manager Beets <br />briefly reviewed the request for signage on the canopy <br />of the SA store by amending the existing Conditional <br />Use Permit. <br /> <br />Councilmember Ihlan sought clarification of the <br />square footage allowed and why a Conditional Use <br />Permit Amendment was necessary when the City's <br />zoning code allowed the square footage. <br /> <br />City Attorney Anderson clarified that the signage was <br />addressed in the Conditional Use Permit (CUP), <br />whether or not allowed within the zoning district, <br />requiring amendment of the CUP. <br /> <br />Community Development Director Dennis Welsch <br />confirmed that the original CUP did not allow for <br />signage on the canopy. <br /> <br />[3.1] <br />Kough moved, Pust seconded, adoption of Resolution <br />No. 10396 entitled, "A Resolution Approving an <br />Amendment to an Existing Conditional Use Permit to <br />Allow 83 square feet of signage along the East and <br />North Edge of a Fuel Canopy, Located at Speedway <br /> <br />Resolution 10396 <br />Speedway <br />SuperAmerica <br />CUP Amendment <br />2295 Rice Street <br />(PF 3711) <br />
