City Council Regular Meeting - 06/12/06
Minutes - Page 17

Ayes: Kough and Ihlan.
Nays: Pust; Maschka and Klausing.
Motion failed.

Kough moved, Ihlan seconded, that language be amended that
the Ethics Commission do its own investigations, not the City
Attorney or the City Manager, due to potential conflicts of
interest issues.

Councilmember Kough spoke in strong support of the motion.

Councilmember Ihlan opined that the independence of the Ethics
Commission was very important, but that she could be persuaded
on their roles; but was troubled by taking investigatory authority
away from the Ethics Commission; and would prefer additional
study by the Task Force and Professor Schultz; however, at this
time she was supportive of the amendment.

Councilmember Pust opined that she felt strongly in the
opposite; that what was done in the past was inappropriate; and
since investigations included private infonnation, it should not
be in the hands of appointed citizens, but in the hands of trained
professionals, well-versed in employment operations; data
privacy restrictions; and spoke in strong support of the proposed
language, and in opposition to this proposed amendment.

Roll Call

Ayes: Kough and Ihlan.
Nays: Pust; Maschka and Klausing.
Motion failed.

Kough moved to reinstate old language provisions (referenced as
Section 3.r) related to Elected Officials not exceeding their
authority.

Mayor Klausing ruled the motion out of order, noting that it had
been voted down at the last meeting.

Councilmember Ihlan appealed the motion of the Chair.

Roll Call
