Also effective that date. the current ordinance prohibitions aaainst all <br />fertilizer applications within ten feet of any wetland or water resource <br />and the seasonal restriction will be preempted. althouah state <br />reaulations reaardina application proximate to water resources. if any. <br />will applv. and the seasonal application limitation lanauaae would still <br />seem applicable. althouah somewhat indirectlv throuah the impervious <br />surface restriction. <br /> <br />3. Since Roseville currentlv does not address the sale of fertilizer <br />containina phosphorus. this aspect of the bill will have no affect on <br />current city code provisions. However. if the Council wants to consider <br />restrictina the sale of fertilizer containina phosphorus. it has until <br />Auaust 1. 2002 to adopt that ordinance. <br /> <br />Options for Sale Restrictions. <br /> <br />Cities have considered various approaches to sales restrictions: <br /> <br />Example 1: Retail businesses selling fertilizer shall post a notice in a <br />conspicuous location near the fertilizer notifying customers of the limitation on the <br />use of fertilizer containing phosphorous contained in this Chapter. (Burnsville City <br />Code 7-9-4) <br /> <br />Example 2: No person, firm, corporation, franchise, or commercial <br />establishment shall sell or display for sale any lawn fertilizer, liquid or granular, <br />within the City of Plymouth that contains any amount of phosphorous or other <br />compound containing phosphorous, such as phosphate, unless: <br /> <br />(a) Phosphorous-free fertilizer is also available for sale. <br /> <br />(b) Phosphorous-free fertilizer and fertilizer with phosphorous are <br />separately displayed with each display being clearly marked as to <br />whether or not the ferti I izer contai ns phosphorous. <br /> <br />(c) Displays of phosphorous-free fertilizer are of equal or greater size <br />and prominence. <br /> <br />(d) A sign or brochure is on prominent display next to any fertilizer <br />display containing the City of Plymouth's regulations concerning <br />the use of ferti I izer with phosphorous. (Plymouth City Code <br />911 70.07). <br /> <br />Example 3: Effective January 1, 2002, no person, firm, corporation, franchise, or <br />commercial establishment shall sell any lawn fertilizer, liquid or granular, within <br />the city of Minneapolis that contains any amount of phosphorus or other <br />compound containing phosphorus, such as phosphates, except: <br />
