<br />of available phosphorus in the soil is insufficient to support healthy turf growth; <br />(2) the property owner or an agent of the property owner is first establishing turf <br />via seed or sod procedures, and only during the first growing season; or (3) the <br />fertilizer containing the plant food phosphorus is used on a golf course under the <br />direction of a person licensed, certified, or approved by an organization with an <br />ongoing training program approved by the commissioner. <br /> <br />The law also requires the state to prepare consumer information for phosphorus <br />fertilizer application suitable for distribution at retail points of sale, a research <br />study of the effectiveness of this year's legislation due back to the legislature in <br />January 2007, and a prohibition of any fertilizer application to an impervious <br />surface. <br /> <br />Roseville's current reaulatory provisions. <br /> <br />The City Code currently only regulates the application of fertilizer containing <br />phosphorus. There are no restrictions on phosphorus fertilizer sales. <br /> <br />Roseville City Code ~408.03 limits the application of granular fertilizers <br />containing more than 30/0 phosphorus content and liquid fertilizer which contains <br />more than one-half percent (0.50/0), by weight, of phosphate unless the single <br />application is less than or equal to ten one-hundredths (0.10) pound of <br />phosphate per one thousand (1,000) square feet. <br /> <br />The quantity of phosphate applied to newly established turf areas is not limited <br />by this subsection during the first growing season. <br /> <br />Annual application amount shall not exceed five-tenths (0.5) pound of phosphate <br />per one thousand (1,000) square feet of lawn area. <br /> <br />Like the state law, the City Code provides that no person shall apply fertilizer to <br />impervious surfaces. <br /> <br />The City Code has two additional features not found in the state law. First, the <br />City Code imposes a complete ban on fertilizer application within ten feet (10') of <br />any wetland or water resource and second, provides that lawn fertilizer <br />applications shall not be applied when the ground is frozen or between January 1 <br />and April 15, and between November 15 and December 31. <br /> <br />Impact of new leaislation on City Code <br /> <br />1. The City's current restrictions on application will be enhanced in some <br />respects and preempted in other respects. Specificallv. effective <br />January 1. 2004 the 3%/50/0 limits will become 00/0. <br />
