of available phosphorus in the soil is insufficient to support healthy turf growth;
(2) the property owner or an agent of the property owner is first establishing turf
via seed or sod procedures, and only during the first growing season; or (3) the
fertilizer containing the plant food phosphorus is used on a golf course under the
direction of a person licensed, certified, or approved by an organization with an
ongoing training program approved by the commissioner.

The law also requires the state to prepare consumer information for phosphorus
fertilizer application suitable for distribution at retail points of sale, a research
study of the effectiveness of this year's legislation due back to the legislature in
January 2007, and a prohibition of any fertilizer application to an impervious
surface.

Roseville's current reaulatory provisions.

The City Code currently only regulates the application of fertilizer containing
phosphorus. There are no restrictions on phosphorus fertilizer sales.

Roseville City Code ~408.03 limits the application of granular fertilizers
containing more than 30/0 phosphorus content and liquid fertilizer which contains
more than one-half percent (0.50/0), by weight, of phosphate unless the single
application is less than or equal to ten one-hundredths (0.10) pound of
phosphate per one thousand (1,000) square feet.

The quantity of phosphate applied to newly established turf areas is not limited
by this subsection during the first growing season.

Annual application amount shall not exceed five-tenths (0.5) pound of phosphate
per one thousand (1,000) square feet of lawn area.

Like the state law, the City Code provides that no person shall apply fertilizer to
impervious surfaces.

The City Code has two additional features not found in the state law. First, the
City Code imposes a complete ban on fertilizer application within ten feet (10') of
any wetland or water resource and second, provides that lawn fertilizer
applications shall not be applied when the ground is frozen or between January 1
and April 15, and between November 15 and December 31.

Impact of new leaislation on City Code

1. The City's current restrictions on application will be enhanced in some
respects and preempted in other respects. Specificallv. effective
January 1. 2004 the 3%/50/0 limits will become 00/0.
