City Council Regular Meeting - 07/10/06 <br />Minutes -Page 26 <br />Klausing responded affirmatively that, at this time, discussion <br />was concentrated on the Green Mill establishment. <br />City Attorney opinion was sought by Mayor Klausing, from a <br />judiciary capacity, regarding how to proceed since the licensee, <br />Green Mill, was not present at tonight's hearing. <br />City Attorney Anderson recommended proceeding; noting that <br />the licensee had chosen not to appear and/or provide any <br />additional information; to enter into the record that a June 19, <br />2006 letter (attached) was sent from the City Attorney Office to <br />the licensee; that the Green Mill's call to City Manager Beets <br />acknowledged receipt of the letter; and the City Manager's letter <br />had imposed the penalties, given the mitigating information <br />given to the City Manager and relied upon by him to impose the <br />penalty. <br />City Attorney Scott Anderson presented, as part of the record, <br />letters dated Friday, October 28, 2005, from City Manager Beets <br />to each specific business as referenced above, responding the <br />their appeal to the Police Chief's August 24, 2006 notice <br />informing each of their failure to pass an alcohol compliance <br />check; subsequent hearings held between the specific <br />organizations and City Manager Beets; and the City Manager's <br />acceptance and subsequent actions regarding mitigating <br />testimony. <br />City Attorney Anderson and City Councilmembers addressed <br />concerns related to data privacy issues in public review of the <br />correspondence. <br />City Attorney Anderson reviewed the City Manager letter to the <br />Green Mill dated October 28, 2005, specifically paragraph four <br />defining information presented by Green Mill in mitigation of <br />the violation. <br />Councilmember Ihlan expressed her concern about the apparent <br />failure of Green Mill to send a representative to this Public <br />Hearing. <br />City Attorney Anderson advised that the City Council was <br />
