<br />City Council Regular Meeting - 07/10/06 <br />Minutes - Page 27 <br /> <br />entitled to move forward at this time. <br /> <br />Considerable discussion ensued among Councilmembers, Chief <br />Sletner and City Attorney Anderson regarding process; and <br />preferred action. <br /> <br />In order to have full disclosure, Police Chief Sletner, advised that <br />the Green Mill had a non-compliance violation in March of <br />1998, as well as in August of2005. <br /> <br />Discussion included penalty provisions set forth in Section <br />302.15 of City Code and their presumptive nature and possible <br />deviations as deemed appropriate by the City Council; no <br />reported conversations between the serving person and underage <br />person at the time of the violation; City records of <br />server/manager training before and at the time of violation; and <br />factual determinations for each specific establishment at the <br />close of the Public Hearing. <br /> <br />Chief Sletner reviewed the circumstances specific to the <br />violations at Old Chicago and the VFW, which were similar in <br />nature. <br /> <br />Douglas L. Christman, General Counsel, Vice President, Legal <br />Affairs with Rock Bottom Restaurants, Inc., a Delaware <br />Corporation headquartered in Denver, CO, was present <br />representing Old Chicago. <br /> <br />Mr. Christman reviewed his letter to City Attorney Anderson <br />dated June 23, 2006, (attached). Mr. Christman advised that Old <br />Chicago took their responsibility very seriously, operating in 22 <br />different states, and in 77 different jurisdictions, and aware of the <br />federal, state and local regulations related to each. Mr. <br />Christman reviewed the company's extensive in-house training; <br />zero tolerance stance; secret shopper program to spot-check <br />compliance; employee handbook language regarding responsible <br />alcohol service and internal policies in place. <br /> <br />Mr. Christman advised that, under the zero tolerance stance of <br />the company, the server's violation had prompted their job loss; <br />and noted that Old Chicago had not responded in a timely <br />
