<br />City Council Regular Meeting - 07/10/06 <br />Minutes - Page 28 <br /> <br />manner to the June 2005 notice of compliance checks, as well as <br />subsequent correspondence and notice of violation, which he <br />attributed to the staff person handling compliance issues being <br />out of the office for family leave. Mr. Christman advised that, <br />when the matter was discovered, his firm had responded in a <br />timely manner and in working with the City Manager, presenting <br />apparent authority on behalf of the City Council, had thought the <br />matter was closed. <br /> <br />Mr. Christman respectfully requested that the City Council ratify <br />the actions and sentence levied by the City Manager. <br /> <br />Discussion included training verification by the City; previous <br />alcohol compliance check failures of Old Chicago; appropriate <br />penalties outside the thirty-six (36) month window for the <br />purposes of deviation; annual training for alcohol compliance; <br />Perceived apparent authority of the City Manager interpreted by <br />Old Chicago, when the ordinance language was contrary; and <br />whether Police Chief Sletner had concurred with the City <br />Manager's decision, with her responding, "I did not." <br /> <br />VFW, Post 7555 <br />In order to have full disclosure, Police Chief Sletner, advised that <br />the VFW had a non-compliance violation in March of 1998, as <br />well as in August of2005. <br /> <br />Chief Sletner reviewed the similar circumstances of the violation <br />at the VFW; noting that a subsequent conversation between the <br />wait person and the undercover officer when advised of the <br />violation, the wait person told the officer that she recognized her <br />as a police officer and advised the officer that she didn't think <br />the officer would bring someone underage in for a drink. At that <br />point, the undercover officer showed the wait person a copy of <br />the notice regarding compliance checks, reminding the wait <br />person that identifications should always be verified. <br /> <br />VFW representatives, Roseville Post Commander Glen Fadden <br />and Roseville Post Manager Sue McMahan were present. <br /> <br />Commander Fadden advised the City Council that the VFW was <br />not questioning that the violation had occurred, but asked that the <br />
