Gillen, General Manager <br />Green Mill Restaurant and Bar <br />145 Rosedale Center <br />Roseville, MN 55113 <br /> <br />Re: Liquor License <br /> <br />Dear Mr. Gillen, <br /> <br />This is my response to your appeal from the Police Chiefs August 24th <br />notice informing you of your failure to pass an alcohol compliance check. <br />My response is based upon the entire record in this case, including the <br />hearing on Tuesday, September 27L". Based on that record, I make the <br />following findings of facts. <br /> <br />On August 12, 2005, your employee, Roxanne Cossny Lot..h, was cited by <br />the Roseville Police Department for serving alcohol to an under-aged <br />individual. Green Mill does not contest the fact that this violation took <br />place. Your server did indeed provide alcohol to a minor. <br /> <br />Accordingly, the Police Chief sent you a notice fining you $500 and <br />suspending your liquor license for one-day. This is the penalty <br />prescribed under the Roseville City Code. (Your establishment did not <br />qualifY for a lesser sanction under the City Code because you do not <br />participate in the City's Optional Manager and Server Training Program. <br />Participants in that Program are subject to lesser sanctions for liquor <br />violations in return for licensees carrying out a robust and aggressive <br />liquor training program for each employee who serves alcohol.) <br /> <br />At the hearing you presented certain information in mitigation of the <br />violation. Specifically, you explain that the server in question has paid <br />her fine and received a formal written warning about serving under-age <br />persons. In addition, you have retrained your front-of-the-store staff. <br />Finally, you indicate a desire to do more training. <br /> <br />For the following reasons, I have decided to accept the mitigation <br />testimony: <br /> <br />· Your demeanor at the hearing suggests to me that you take your <br />liquor serving duties very seriously; <br /> <br />· You acknowledge that serving alcohol to minors is a serious <br />offense; and <br />
