<br />City Council Regular Meeting - 09/11/06 <br />Minutes - Page 24 <br /> <br />Anderson opined that seeking legal opinions at this time from the <br />various attorneys currently involved would prove more cost- <br />effective if and when outside and independent legal counsel were <br />sought. <br /> <br />Councilmembers Ihlan and Kough spoke III opposition to the <br />motion. <br /> <br />Councilmember Pust spoke in support of the motion, indicating <br />her adamant preference for additional information, staff and legal <br />advice. <br /> <br />Roll Call <br />Ayes: Maschka; Pust and Klausing. <br />Nays: Ihlan and Kough. <br /> <br />Pust moved, Maschka seconded, staff and legal counsel analysis <br />of the effect on the City to dissolve or remove master plans from <br />the amended Comprehensive Plan, and City Policy adoption to <br />discontinue this practice, on the basis of the procedural errors <br />outlined by the Court of Appeals; and whether that created a <br />procedural quandary for the City and/or staff. <br /> <br />Roll Call <br />Ayes: Maschka; Pust and Klausing. <br />Nays: Ihlan and Kough. <br /> <br />Councilmember Pust sought additional information and a legal <br />opinion as to blackout all amendments to the Comprehensive Plan <br />and the legal implications of doing so; as well as the Metropolitan <br />Council's input and analysis of such action. <br /> <br />Staff was directed to report back to the City Council at the <br />September 18, 2006 meeting, with additional information and cost <br />analysis for proposed services of those three firms responding to <br />the City's request for outside and independent legal counsel <br />consideration. <br /> <br />Mayor Klausing noted that, if necessary, action items and motions <br />could be pursued at that meeting, at the discretion of the Council <br />majority. <br />
