REQUEST FOR COUNCIL ACTION <br /> Date: 5/14/2012 <br /> Item No.: 7.h <br />Department Approval City Manager Approval <br />Item Description: Approve a Resolution to Accept the Work Completed, Authorize Final <br />Payment, and Commence the One-Year Warranty Period on the Rosewood <br />Wetland and Midland Hills Road Drainage Improvements <br />B <br />ACKGROUND <br />1 <br />On October 25, 2010, the City Council awarded the Rosewood Wetland and Midland Hills Road <br />2 <br />Drainage Improvements project to Minnesota Dirt Works, Inc. The work for this contract was <br />3 <br />finished in January, 2012, and the contractor has requested final payment. This project consisted <br />4 <br />of the expansion of a wetland located between 2235 and 2211 Rosewood Lane North and the <br />5 <br />construction of an underground storage chamber along Midland Hills Road. <br />6 <br />PO <br />OLICYBJECTIVE <br />7 <br />City policy requires that the following items be completed to finalize a construction contract: <br />8 <br />Certification from the City Engineer verifying that all of the work has been completed in <br />9 <br />accordance with plans and specifications. <br />10 <br />A resolution by the City Council accepting the contract and beginning the one-year warranty. <br />11 <br />FI <br />INANCIALMPACTS <br />12 <br />The final contract amount, $245,425.87, is $26,255.97 more than the awarded amount of <br />13 <br />$219,169.90. This represents an increase in the contract of 12%. The cost increase is the result of <br />14 <br />two project change orders. The change orders were due to unforseen circumstances in the field. <br />15 <br />Utility conflicts required some modifications to the design. Due to wetter conditions, there was a <br />16 <br />change in the approach for excavating the wetland, which required the use of additional, special <br />17 <br />equipment. The depth of the wetland was also increased in working with adjacent property <br />18 <br />owners, which resulted in additional excavated material, as well as some additional tree removal. <br />19 <br />Decisions regarding this additional work needed to be made while the work was being completed, <br />20 <br />not allowing for the processing of a change order prior to the execution of the work. <br />21 <br />This project was funded using Storm Sewer Infrastructure Funds, as well as cost-share dollars <br />22 <br />received from the Ramsey Conservation District and the Rice Creek Watershed District. <br />23 <br />SR <br />TAFF ECOMMENDATION <br />24 <br />Since all necessary items have been completed in accordance with project plans and <br />25 <br />specifications, staff recommends the City Council approve a resolution accepting the work <br />26 <br />completed as the Rosewood Wetland and Midland Hills Road Drainage Improvements and <br />27 <br />authorize final payment of $18,636.29 <br />28 <br />RCA <br />EQUESTEDOUNCILCTION <br />29 <br />Approve the resolution accepting the work completed as Rosewood Wetland and Midland Hills <br />30 <br />Road Drainage Improvements, starting the one-year warranty and authorizing final payment. <br />31 <br />Prepared by: Kristine Giga, Civil Engineer <br />Attachments: A: Resolution <br /> B: City Engineer Certification <br />Page 1 of 1 <br /> <br />
