<br />City Council Regular Meeting - 09/25/06 <br />Minutes - Page 15 <br /> <br />small road and future maintenance of a private road. <br /> <br />Mr. Stark noted that the City had standard designs for dimensions <br />to allow emergency and maintenance vehicles access; and the cul- <br />de-sac portion of the road accomplished those dimensions. Mr. <br />Stark noted that, to build a public road to City specifications, it <br />would create excessive costs for upkeep and maintenance that <br />would exceed the public need. <br /> <br />Mayor Klausing spoke against the motion; recogmzmg <br />neighborhood concerns, but noting the additional Council control <br />by granting a PUD, rather than a simple re-platting. <br /> <br />Applicant, Arthur Mueller, 2201 Acorn Road <br />Mr. Mueller spoke to the development; storm water drainage <br />plans being drawn by the engineer at this time, with Rice Creek <br />Watershed District preliminary approval; his intent regarding the <br />subdivision and desire to preserve the neighborhood and trees; <br />homeowner association ownership of the private road; widths of <br />the road as dictated by the City Engineer; his willingness for "No <br />Parking" along Acorn Road; and adequacy of private driveways <br />for parking. Mr. Mueller noted that a smaller road will impact <br />fewer trees; and opined that the proposed homes and size of the <br />lots, along with proposed privacy, would only enhance the <br />neighborhood. <br /> <br />Councilmember Ihlan expressed appreciation to the applicant for <br />his commitment to the neighborhood. <br /> <br />Mayor Klausing spoke against the motion; opining that he didn't <br />see compatibility as a court basis; and reiterated the greater <br />controls available to the City with the PUD application. Mayor <br />Klausing expressed disappointment with past discussions on tree <br />preservations versus tonight's proposed action to not honor the <br />applicant's attempt to preserve trees. <br />Ihlan moved, Kough seconded, DENIAL of the <br />PRELIMINARY PLAT, creating four single-family lots and a <br />private road; based on concerns about compatibility of four <br />single-family lots with a road surrounding the neighborhood; <br />loss of trees and open space; drainage issues with contiguous <br />properties remain unanswered at this time; and concerns that <br />
