<br />City Council Regular Meetiug - 09/25/06 <br />Minutes - Page 24 <br /> <br />the experience and background data already available. <br /> <br />Councilmember Kough opined that this update was premature <br />prior to the Supreme Court responding to the petition to hear the <br />Twin Lakes LLC case. <br /> <br />Councilmember Ihlan opined that there were other options besides <br />the AUAR (i.e., Environmental Impact Statement); and this action <br />would be premature; reiterating her preference for an independent <br />legal opinion related to Twin Lakes redevelopment area issues. <br />Councilmember Ihlan further opined the need to pursue an RFP. <br /> <br />Mayor Klausing opined that an agreement remained in place with <br />Twin Lakes LLC, and clarified the Court of Appeals written <br />findings. <br /> <br />Councilmember Pust sought clarification regarding whether the <br />Twin Lakes LLC proposal needed to be included; with Mr. Stark <br />responding affirmatively, as per AUAR rules. Councilmember <br />Pust opined that the AUAR update process will be in process for <br />several months, and within that time frame a decision from the <br />Supreme Court should be available to determine if the Twin Lakes <br />LLC proposal should be included in the final documents. <br /> <br />Mr. Stark advised that additional staff rationale for utilizing the <br />services of DSU is that there have been four AUAR updates in <br />Minnesota history, and DSU had performed all of them, and they <br />were recognized experts in the field. <br /> <br />Klausing moved, Maschka seconded, approval of a contract <br />between the City of Roseville and DWU to prepare the 2006 <br />AUAR Update for the Twin Lakes Redevelopment Area. <br /> <br />Roll Call <br />Ayes: Maschka; Pust and Klausing. <br />Nays: Ihlan and Kough. <br />Motion carried. <br /> <br />Staff was directed to add several additional environmental issues <br />for consideration in the AUAR update, as outlined by <br />Councilmember Ihlan as follows: <br />
