Councilmember Kough opined that this update was premature prior to the Supreme Court responding to the petition to hear the Twin Lakes LLC case. Councilmember Ihlan opined that there were other options besides the AUAR (i.e., Environmental Impact Statement); and this action would be premature; reiterating her preference for an independent legal opinion related to Twin Lakes redevelopment area issues. Councilmember Ihlan further opined the need to pursue an RFP. Mayor Klausing opined that an agreement remained in place with Twin Lakes LLC, and clarified the Court of Appeals written findings. Councilmember Pust sought clarification regarding whether the Twin Lakes LLC proposal needed to be included; with Mr. Stark responding affirmatively, as per AUAR rules. Councilmember Pust opined that the AUAR update process will be in process for several months, and within that time frame a decision from the Supreme Court should be available to determine if the Twin Lakes LLC proposal should be included in the final documents. Mr. Stark advised that additional staff rationale for utilizing the services of DSU is that there have been four AUAR updates in Minnesota history, and DSU had performed all of them, and they were recognized experts in the field. Klausing moved, Maschka seconded, approval of a contract between the City of Roseville and DWU to prepare the 2006 AUAR Update for the Twin Lakes Redevelopment Area.
