<br />City Council Regular Meeting -10/09/06 <br />Minutes - Page 22 <br /> <br />whether they will hear the petition. <br /> <br />City Attorney Anderson advised that from a legal standpoint, with <br />the submittal of another application, it had been prudent of staff to <br />come forward to pursue analysis prior to a 120 day maximum <br />review period had been activated. <br /> <br />Additional discussion included the status of the Eminent Domain <br />proceedings; whether the City should amend past practices of <br />including Master Plans in the Comprehensive Plan; and Eminent <br />Domain terminations and their impacts on the "grandfathered" <br />status of the legislation. <br /> <br />Mr. Stark advised that staff was completing a list of where Master <br />Plans were listed in the Comprehensive Plan, where the linkages <br />were, and where they met; with anticipated submittal to legal <br />counsel for their recommendation on how to proceed, and whether <br />to terminate the relationship between Master Plans and the <br />Comprehensive Plan. <br /> <br />City Attorney Anderson further addressed the policy and/or legal <br />issues of including Master Plans in Comprehensive Plans, and his <br />firm's strong advice that it was not appropriate to include details <br />of a Master Plan in a Comprehensive Plan, as it was inconsistent <br />with the purpose of a Comprehensive Plan created to provide <br />general guidelines within which things would fall. <br /> <br />Councilmember Ihlan opined that the City's previous <br />authorization to update the AUAR was premature and an <br />expenditure of public funds inappropriate until legal advice on <br />environmental issues had been received, and prior to Supreme <br />Court response. <br /> <br />Mayor Klausing sought clarification on staff as to the status of the <br />AUAR review and how that would be impacted by submission of <br />a new proposal. <br /> <br />Mr. Stark advised that the consulting firm, DSU, was in their data- <br />gathering stage (i.e., traffic counts, movements, etc.) and, as <br />required of any environmental review, and new application <br />impacts, if any at all in land use approvals, could not be given <br />
