<br />City Council Regnlar Meeting -10/09/06 <br />Minutes - Page 23 <br /> <br />until required environmental approvals were given. <br /> <br />City Attorney Anderson concurred with staff, noting that once it <br />was determined if the proposal was adequate, and whether it met <br />mandatory thresholds for environmental review, the information <br />being gathered would assist staff to move forward with the <br />environmental review within and extending the land use review <br />period, and the data could be used by staff and the developer, on a <br />cost-shared basis, for future reference. Mr. Anderson <br />recommended proceeding with the AUAR update process. <br /> <br />Staff was directed to have Jim Casserly attend the October 16, <br />2006 Council Study Session to provide a legal opinion on the <br />Eminent Domain status; whether it was possible to withdraw a <br />Quick Take action; whether the City should amend past practices <br />of including Master Plans in the Comprehensive Plan; and <br />responses, as available and appropriate, to the other list of legal <br />questioned previously outlined by the City Council and provided <br />to staff. Mayor Klausing noted that this update would be a <br />starting point, and additional issues could be pursued at that time, <br />and would allow staff to have done a more in-depth review of the <br />new application. <br /> <br />Staff was directed to report on their opinion of the application <br />review process and provide their preliminary findings as to the <br />consistency of the plan with the Twin Lakes Master Plan, for the <br />public and City Council's information. <br /> <br />It was Council consensus that the number and status of Master <br />Plans attached to the Comprehensive Plan was an important <br />policy discussion for a future discussion. <br /> <br />Councilmember Ihlan reiterated her proposal to bring for <br />discussion the need for independent legal counsel for <br />environmental review purposes; and noted she would propose <br />future action by the City Council. <br /> <br />9. <br /> <br />Accept Petition from Westwood Village I Residents and Set a <br />Public Hearing for November 13,2006 <br />Housing & Redevelopment Authority Executive Director Cathy <br />Beunett reviewed the HRA staff's work with the Westwood <br /> <br />Accept Petition <br />Westwood Village I <br />Set a Public <br />Hearing for <br />
