<br />City Council Study Session -10/16/06 <br />Minutes - Page 11 <br /> <br />for local control and local decision-making for <br />communities and their citizens. <br /> <br />Mayor Klausing thanked Mr. Jambois for his presentation; <br />and requested a copy of the AMM Policies for the 2006/07 <br />legislative year, once they're available. <br /> <br />5. <br /> <br />Receive an Update from the Development Attorney <br />regarding Twin Lakes Issues <br />Mayor Klausing and Community Development Director John <br />Stark outlined the specific questions from last week's Council <br />meeting, and noted that Mr. Stark and Development Attorney <br />Rod Krass would attempt to answer those questions. <br /> <br />Development Attorney Rod Krass noted that he was constrained <br />about this discussion in open public forum, given the present <br />situation with the City in major litigation regarding <br />condemnation, the need to protect the contractual and good faith <br />covenant agreement between the City and developer; and the <br />financia~ impacts to both or either party that may be a result of <br />any decisions and/or discussion at the table tonight. <br /> <br />Councilrnember rhlan suggested a closed executive session for <br />discussion. <br /> <br />Discussion included advice of City Attorney Jay Squires as to <br />whether to close the meeting tonight, or at a future meeting, <br />given legal notification requirements, and attorney/client <br />provisions; Mr. Kough's absence from this discussion; costs for <br />Mr. Krass's time; and no prior notice to the public of a closed <br />seSSIOn. <br /> <br />After further discussion, it was Council consensus to hold off on <br />a Closed Executive Session until October 23, 2006, at <br />approximately 5:30 p.m., just prior to the regular business <br />meeting. Staff was so directed to provide appropriate public <br />notice and postings. <br /> <br />Mr. Stark reviewed various questions related to the level of <br />environmental review - whether a broad-based AUAR or a <br />project-specific EA WIErS - preferred, monetary benefits and <br /> <br />Update from the <br />Development <br />Attorney regarding <br />Twin Lakes Issues <br />
