<br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br />RESOLUTION NO. 10444 <br /> <br />WHEREAS, Mounds View School Disllict 621 ("Mounds View") owns the real <br />propel1y located at 2959 Hamline A venue North in the City of Roseville, consisting of <br />approximately 3.3 acres (the "PropeI1y"); and <br /> <br />WHEREAS, soils and groundwater at the Property are cUITently contaminated; and <br /> <br />WHEREAS, Mounds View desires to clean up the existing contamination and sell the <br />Propel1y to a developer who will constmct new housing on the Propel1y (the "Project"); and <br /> <br />WHEREAS, Mounds View needs assistance with the cost of investigating and cleaning <br />up the contamination and desires to seek such assistance through the Minnesota DepaJ1meut of <br />Employment and Economic Development's Contamination Investigation & RAP Development <br />Grant and Contamination Cleanup Grant programs, the Metropolitan Council's Metropolitan <br />Livable Communities Tax Base Revitalization Account, and Ramsey County's Environmental <br />Response Fund (collectively, the "Grant ProgralTIs"); and <br /> <br />WHEREAS, Mounds View has asked the City of Roseville to act as the legal sponsor for <br />the Project for purposes of submitting applications to the Grant Programs on November I, 2006 <br />(collectively, the "Grant Applications"); and <br /> <br />WHEREAS, the Project is consistent with the City of Roseville' s comprehensive plan <br />for land use in the area; and <br /> <br />WHEREAS, cleanup and redevelopment of the Property will benefit residents of the <br />City of Roseville through remediation of existing contamination and increasing the tax base; and <br /> <br />WHEREAS, the City of Roseville has the legal authOlity to apply for financial <br />assistance, and has the institutional, managerial, and financial capability to ensure adequate <br />project administration; and <br /> <br />WHEREAS, the sources and amounts of the local match identified in the Grant <br />Applications are committed to the Project; and <br /> <br />WHEREAS, the City of Roseville has not violated any federal, state or local laws <br />pel1aining to fraud, blibery, graft, kickbacks, collusion, conflict of interest or other unlawful or <br />conupt practice; and <br /> <br />WHEREAS, the City of Roseville is a participant in the Livable Communities Act's <br />Housing Incentives Program for 2006 as detennined by the Metropolitan Council, and is <br />therefore eligible to make application for funds under the Tax Base Revitalization Account; and <br /> <br />WHEREAS, the Project meets the Tax Base Revitalization Account's purposes and <br />critelia; <br /> <br />3538044.1 <br />
