This understanding had prompted staff to <br />communicate with Councilmembers to coordinate calendars to <br />schedule the budget work sessions. <br /> <br />Mr. Beets stated that, while no signed authorization had been <br />filed by Mayor Kysylyczyn authorizing the meeting, it was <br />implicit by intent that the Mayor and Councilmembers had <br />received due notice, with publication and posted notice as per <br />Open Meeting Law requirements, over several months <br />regarding the meeting schedule. <br /> <br />Mr. Beets further indicated that City Attorney Jamnik had been <br />present during scheduling discussions, and had not expressed <br />compliance concerns regarding the meetings. Mr. Beets <br />indicated that he was confident that the letter of the law and <br />notification process had been met, that no action was proposed, <br />and that the meeting should continue. <br /> <br />After further discussion of those Councilmembers present <br />regarding options for allowing further discussion of the 2003 <br />budget, it was the consensus that only two (2) Councilmembers <br />would remain for the discussion, thereby eliminating a quorum <br />of the Council present. <br /> <br />In order to ensure compliance with Open Meeting laws, and <br />Minnesota Statutes 412.191, Subd. 2., Councilmember <br />Maschka left the meeting at 6:45 p.m., and Mayor Kysylyczyn <br />left the meeting at 6:52 p.m. <br /> <br />Budget Work Session No.3 <br />Thursday, August 1, 2002 <br />MEETING NOTES <br /> <br />Presentations <br />Councilmember Kough, in his capacity as Acting Mayor, <br />presided over the Budget Work Session No.3 to hear staff <br />presentations regarding the 2003 Budget. <br /> <br />Present: Councilmembers Kough and Schroeder <br /> <br />Staff <br /> <br />6:55 p.m. <br />
