<br />Special City Council Minutes - 09/03/02 <br />Page 12 <br /> <br />came up at the Commission level, and they hired an attorney <br />from the League of Minnesota Cities who directly stated that <br />neither the Council nor Charter Commission could take a stand <br />as a body. Ms. Sobola stated that she would provide a copy of <br />the legal opinion to all Councilmembers, along with City <br />Attorney Jamnik. <br /> <br />City Attorney Jamnik's initial opinion did not support the <br />comments made by Ms. Sobola. <br /> <br />Mayor Kysylyczyn asked for City Attorney Jamnik's opinion <br />on an additional item on the agenda, the appointments to the <br />Housing and Redevelopment Authority (HRA). City Attorney <br />J amnik responded that the appointments should be considered <br />at a future, regular public meeting. <br /> <br />Councilmember Klausing requested that, for information <br />purposes for the entire City Council, when the Mayor <br />recommended appointments, he use a similar criteria model as <br />that used by City Manager Beets on his appointment of various <br />City Attorneys. <br /> <br />Mayor Kysylyczyn quoted Chapter 469.03 of State Statute <br />regarding his legal obligations as mayor. <br /> <br />Klausing moved, Maschka seconded respectfully requesting <br />Mayor Kysylyczyn's provision of his suggested HRA <br />appointees the week prior to the meeting seeking action. <br /> <br />Ayes: <br />Nays: <br />Abstentions: <br /> <br />Roll Call <br />Maschka, Klausing and Kough. <br />None. <br />Schroeder and Kysylyczyn. <br /> <br />Motion carried. <br /> <br />Councilmember Kough encouraged the Mayor to comply with <br />this courtesy request. <br /> <br />City Attorney Jamnik addressed Mayor Kysylyczyn's concerns <br />that while not a legal requirement of his office, it was simply a <br /> <br />New Agenda <br />Item - HRA <br />Appointments <br />
