<br />Regular City Council Minutes -10/21/02 <br />Page 25 <br /> <br />confirmation of the firm of Ratwik, Roszak & Maloney. <br /> <br />Councilmember Schroeder defended his placement of this <br />item on the agenda; following action at the October 14, <br />2002 meeting when the motion had failed; making an <br />assumption that City Manager Beets would want to <br />appoint his second choice for City Atton1ey. <br /> <br />Councilmembers Klausing and Maschka continued to <br />express concerns regarding possible violation of state <br />statute in the appointment process. <br /> <br />Discussion ensued regarding whether the term of the <br />current City Attorney (Campbell Knutson) had expired. <br /> <br />City Manager Beets clarified that the contract had no tern1 <br />and they served until replaced. <br /> <br />Mayor Kysylyczyn stated he was confident in the motion <br />to move forward; and called the vote. <br /> <br />Ayes: <br />Nays: <br /> <br />Roll Call <br />Kough, Schroeder and Kysylyczyn. <br />Maschka and Klausing. <br /> <br />Kough moved, Kysylyczyn seconded, confirmation of the <br />City Manager's appointment of the firm, Jensen, Bell, <br />Converse & Erickson, to serve as the City Prosecutor, <br />subject to negotiation, and Council approval, of a final <br />legal services agreement. <br /> <br />Councilmember Kough's original motion included <br />wording to include directing the City Manager to set up a <br />meeting between the firm, Councilmember Kough, and <br />Mayor Kysylyczyn within the next two weeks to discuss <br />several undisclosed accusations made regarding the firm. <br /> <br />Councilmember Klausing asked for a division of the <br />motion to two separate motions. <br /> <br />After further discussion, Mayor Kysylyczyn sought <br />
