Regular City Council Minutes - 11/18/02
Page 11

Mayor Kysylyczyn stated that the procedure would be the
same as that used for an abatement process.

Councilmember Klausing expressed further concern that
by the City Council becoming involved, politics may
become involved; expressed disappointment that the entire
Council had not been involved in determining whether
there was a need for this paragraph being included in the
proposed contract representing a policy change; and was
adamantly concerned regarding the specific use of
"criminal" citations.

After further discussion, and consulting with Community
Development Director Welsch regarding the average
number of code violations processed by staff in a year,
Mayor Kysylyczyn called the motion.

Ayes:
Nays:

Roll Call
Schroeder, Kough, and Kysylyczyn.
Klausing, Maschka.

D. Approve City Attorney Contract
Kysylyczyn moved, Kough seconded, approval of a
contract with the firm of Ratwik, Roszak and Maloney,
P .A., to provide legal services to the City as the City
Attorney. Kysylyczyn noted that his motion included a
contract change on Page 1, Terms, Section 1.1, a.) and b.),
that meeting attendance was not to collectively exceed
four per month, with the contract showing a yearly total, to
accommodate those months that more or fewer meetings
were scheduled due to recesses or special meetings.

City Attorney Squires commented on the motion, stating
that the 2003 Council meeting schedule would have
conformed to contract language, but if the Council
preferred to stipulate a yearly total, speaking for the law
firm, he thought they would have no objection.

City Manager Beets brought to the Council's attention a
correction on the contract under "Recitals," Item No.3,
Year Two with the dollar amount accurately revised to

City Attorney
Contract
Approval
