<br />City Council Regular Meeting -11/27/06 <br />Minutes - Page 6 <br /> <br />6. <br /> <br />Conduct a Public Hearing to Consider 2007 Liquor License <br />Renewals <br />Mayor Klausing opened the Public Hearing at 6: 18 p.m. <br /> <br />Mr. Miller reviewed the Request for Council Action dated <br />November 27,2006, for consideration of one, off, club, and wine <br />license renewals for the year 2007. Mr. Miller advised that staff <br />recommended approval of all liquor license renewals; noting that <br />the off-sale (liquor store) license currently held by Roseville <br />Properties was not intended to be renewed, and as of January 1, <br />2007, the City would have one remaining off-sale license. <br /> <br />Councilmember Kough requested information of City Attorney <br />Scott Anderson regarding City Code provisions limiting length of <br />time for an applicant to hold a license without being operational. <br /> <br />After discussion, City Attorney Anderson was directed to provide <br />a written legal opinion to the City Council following his review of <br />State Statute and City Code. <br /> <br />Mr. Anderson interpreted the request, and Council verified by <br />consensus, that he would provide a legal opinion as to whether a <br />time limit is property, and the length of time limit that could be <br />imposed in City Code to "use or lose" liquor licenses. Mr. <br />Anderson expressed concern that the proposed 60 days by <br />Councilmember Kough may not allow appropriate time for the <br />applicant to build or lease a facility; as often the license was <br />secured prior to finalization of business operations. <br /> <br />Mayor Klausing closed the Public Hearing at 6:23 p.m.; with no <br />one appearing for or against. <br /> <br />Maschka moved, Kough seconded, approval of the liquor licenses <br />for calendar year 2007, contingent upon all required application <br />items being submitted before the licenses may be issued; as listed <br />on the staff report dated November 27, 2006. <br />Roll Call <br />Ayes: Pust; Kough; Maschka; lhlan and Klausing. <br />Nays: None. <br /> <br />Public Hearing to <br />Consider 2007 <br />Liquor License <br />Renewals <br />
