<br />EXTRACT OF MINUTES OF A MEETING <br />OF THE CITY COUNCIL OF THE <br />CITY OF ROSEVILLE, <br />RAMSEY COUNTY, MINNESOTA <br /> <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />Roseville, County of Ramsey, Minnesota, was duly held in the City Hall at 2660 Civic Center <br />Drive, Roseville, Minnesota, on Monday, the 8th day of September, 1997, at 6:30 p.m.. <br /> <br />The following members were present: Maschka, Mastel, Wiski, Goedeke, and Wall <br />and the following members were absent: None <br /> <br />Member Mastel introduced the following resolution and moved its adoption: <br /> <br />RESOLUTION NO. 9457 <br /> <br />A RESOLUTION AUTHORIZING VACATION OF VARIOUS PRIVATE EASEMENTS IN <br />FAVOR OF THE CITY OF ROSEVILLE AND ITS PREDECESSORS OVER AND ACROSS <br />PROPERTY LOCATED IN THE EAST Yz OF SECTION 8, TOWNSHIP 29, RANGE 23, <br />RAMSEY COUNTY, MINNESOTA AND INTENDED FOR INCLUSION IN THE PLAT <br />OF GATEWAY BUSINESS PARK <br /> <br />WHEREAS, the City of Roseville (the "City") is negotiating a development agreement with Opus <br />Northwest, LLC, a Minnesota limited liability company (the "Developer") pursuant to which the City will acquire <br />various parcels of property located in the southeast quarter of Section 8, Township 29 North, Range 23 West, <br />Ramsey County, Minnesota; record a plat entitled Gateway Business Park which plat includes the above- <br />referenced parcels, other parcels the City currently owns and portions of the County Road B-2 and Long Lake <br />Road rights-of-way; and convey the resulting platted lots to the Developer; and <br /> <br />WHEREAS, the City desires to vacate various private easements in favor of the City that encumber <br />property within the proposed plat of Gateway Business Park; and <br /> <br />WHEREAS, the City intends to dedicate new easements in favor of the public in the plat of Gateway <br />Business Park to the extent necessary to serve the interests of the public. <br /> <br />NOW, THEREFORE, the Roseville City Council hereby resolves as follows: <br /> <br />1. That, upon the recording of the plat of Gateway Business Park, the following easements will no <br />longer be necessary to serve the interest of the pUblic: <br />a) The easement for highway and snow fence purposes in favor of the township of Rose, as set forth <br />in the Highway Easement recorded in the Office of the Ramsey County Recorder as Document No. 1157548; <br />b) The easement for underground sewer mains, pipes and appurtenances together with access and <br />incidental rights as set forth in the Easement recorded in the Office of the Ramsey County Recorder on <br />February 17, 1965 as Document No. 1641638; <br />c) The easement for underground sewer mains, pipes and appurtenances, together with access and <br />incidental rights, as set forth in an easement recorded in the Office of the Ramsey county Recorder on <br />February 17, 1965 as Document No. 1641640; <br /> <br />2. The City Council finds that the vacation of the easements described in Section 1 above is in the <br />interest of the public, and pursuant to Minnesota Statutes Sect. 412.851, the City Council hereby vacates the <br />easements described in Section 1. The vacation is conditioned upon the recording and filing of the plat of <br />Gateway Business Park and is not effective until the recording and filing of the plat of Gateway Business Park. <br /> <br />3.
