<br />City Council Regular Meeting - 12/18/06 <br />Minutes - Page 19 <br /> <br />Mayor Klausing encouraged individual Councilmembers to <br />provide proposed language revisions to City Attorney Anderson <br />prior to consideration at the January 8, 2007 meeting. <br /> <br />City Attorney Anderson clarified with staff the status of the <br />pending land use/subdivision applications, and extension of the <br />60-day review periods, each deadline which would follow the <br />January 8, 2007 meeting. <br /> <br />City Attorney Anderson clarified his reading of recent <br />amendments to Minnesota Statute 15.99 noting that recent <br />amendments indicated that an interim ordinance didn't extend <br />action on applications filed prior to implication of the ordinance; <br />and that the two cases pending would not be covered under this <br />interim ordinance. <br /> <br />Councilmember Pust clarified with City Attorney Anderson that <br />any application filed prior to the January 8, 2007 meeting and <br />potential action, would not be included in the moratorium. City <br />Attorney Anderson concurred. <br /> <br />Ihlan moved, Kough seconded, immediately removing discussion <br />of this item from the table, noting the obvious loopholes being <br />implied for potential applicants, and need to avoid such <br />exemptions prior to implementing the moratorium. <br /> <br />Mayor Klausing, under Roberts Rules, ruled the motion out of <br />order. <br /> <br />Councilmember Ihlan disputed the Chair's findings, and initiated <br />her own research of Roberts Rules at the bench. <br /> <br />City Attorney Anderson clarified that only someone on the <br />winning side of the motion could propose such reconsideration of <br />a motion. <br /> <br />Upon the request of Mr. Stark, Mayor Klausing clarified that the <br />Public Hearing would be continued to the January 8, 2007 regular <br />City Council meeting, with no need to re-notice the meeting. <br />
