<br />City Council Regular Meeting - 01/08/07 <br />Minutes - Page 27 <br /> <br />Rita Zoff, 412 Lovell Avenue (one home removed from house <br />under discussion) <br />Ms. Zoff advised that the property owner had been in business for <br />a considerable time, and alleged that the property owner knew <br />they were violating City Code when then began using the property <br />for business use. Ms. Zoff noted that there were other neighbors <br />concerned, but unable to attend tonight's meeting. <br /> <br />Harold Ristow <br />Mr. Ristow opined that if the applicant wasn't present, they <br />apparently had nothing to say; and further opined that the City <br />Council needed to take steps to shut them down. <br /> <br />Mayor Klausing thanked the residents for their comments; noting <br />they would be retained as part of the record, as the City <br />considered this issue. <br /> <br />Following further discussion, Mr. Stark requested additional time <br />for staff to ensure that the applicant had received proper written <br />notice of tonight's meeting and proposed discussion of their <br />appeal. Mr. Stark clarified that the business had been operating at <br />this site since October I, 2006. <br /> <br />City Attorney Anderson concurred that, pursuant to City Code, <br />Section 108 and the City Council acting as the Board of <br />Adjustments and Appeals, adequate written notice should be <br />provided to the property owner. <br /> <br />Mr. Stark noted that noticing responsibility language was a scope <br />of ordinance language that needed to be clarified further in <br />separate action, allowing more consistency and providing more <br />clear direction for staff to interpret. <br /> <br />Mayor Klausing and Councilmembers Pust and Ihlan concurred <br />that they had heard no evidence to-date that the administrative <br />ruling was incorrect; and assured residents that the delay was to <br />ensure a legal and appropriate process for all parties. <br /> <br />Klausing moved, Pust seconded, tabling action regarding appeal <br />of the Community development Director's Administrative Ruling <br />
