<br />EXTRACT OF MINUTES OF MEETING OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br /> <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />Roseville, County of Ramsey, Minnesota, was held on the 9th day of October, 2006, at 6:00 p.m. <br /> <br />The following members were present: Mayor Klausing and Council Members Ihlan, <br />Kough, Maschka, and Pust, <br />and none were absent; <br /> <br />Council Member Ihlan introduced the following resolution and moved its adoption: <br /> <br />RESOLUTION NO. 10440 <br />A RESOLUTION DENYING A VARIANCE TO ~1004.016 AND IN ACCORDANCE <br />WITH ~1013.02 OF THE ROSEVILLE CITY CODE FOR CHARLES WELECZKI, <br />AND THE VACANT PARCEL AT DALE STREET AND DALE COURT (PF3781). <br /> <br />WHEREAS, Charles Weleczki is the owner of the vacant developable parcel at Dale <br />Street and Dale Court; and <br /> <br />WHEREAS, the subject property is generally described as: <br /> <br />LOT 1, BLOCK 1, WELECZKI ADDITION, EX THAT PART S OF A LINE <br />DESC AS BEG AT THE SW COR OF LOT 1 BLK 1 THENCE N 31 DEG 39 MIN 25 SEC <br />E 92.19 FT TO THE PT OF BEG THENCE S 88 DEG 37 MIN 54 SEC E 112.85 FT TO <br />THE E LINE OF SD LOT AND THERE TERM <br /> <br />WHEREAS, the property owner seeks a 15 foot VARIANCE to S 1 004.0 16 (Residential <br />Dimensional Requirements - Front Yard Setback) to allow greater flexibility in the design of a <br />principal structure on the uniquely shaped parcel at Dale Court and Dale Street; and <br /> <br />WHEREAS, The Roseville Variance Board held the public hearing regarding the <br />VARIANCE request, voting 3-0 to DENY based on their determination that "hardships" were <br />not present and that the need for the variance was created by the applicant/property owner; and <br /> <br />WHEREAS, the applicant has appealed the decision of the Variance Board to the <br />Roseville City Council seeking the Council's support for the requested 15 front yard setback <br />VARIANCE; and <br /> <br />WHEREAS, the Roseville City Council concurs with the determination of the Variance <br />Board, determining the following findings of fact: <br /> <br />1. That a hardship, if any exists, was caused by the current property owner. <br /> <br />2. That a principal structure with attached garage could be designed and constructed <br />on the parcel. <br /> <br />1 <br />
