ATTACHMENT 1 <br />Section 2_05 Vacancies <br />An elective office becomes vacant when �he person elect�d or <br />appointed thereto dies before taking office or fails to qualify, <br />or the incumbent dies, resigns in writing filed wzth the city <br />manager, is convicted of a felony, ceases to reside in ihe city, <br />or is adjudged incompetent by a court of incompeient jurisdiction. <br />If the unexpired term o� the Council vacancy is less than one <br />year from the date of the occurrence of the vacancy, the Council <br />by a majority vote of alI of its remaining members shall <br />appoint a qualified person to fill the vacancy. If the Council <br />fail:� to make the appaintment within sixty (60) days of the <br />occurrence of the vacancy, the mayor shalZ fill the vacancy <br />from the list of qualified applicants. If the unexpired term <br />of the Council vacancy is one year or longer from the date of <br />the occurrence of the vacancy, a specia2 election shall be <br />called by the city manager to fill the vacancy. <br />2_05a Procedtires to FilZ Vacanci�s by Special Election <br />If the unexpired term of the CQUnciZ vacancy is one year or <br />langer, a special electian shall be called by the city manager. <br />The election will be heZd not sooner than ninety (90) days and <br />not later than one hundred twenty {120) days following the <br />occurrence of the vacancy and will otherwise be governed by the <br />provisions of Section 4.02, Special Elections. <br />2.05b Procedures to Fi11::Council Vacancies by Council <br />Appointment. <br />If the unexpzred term of the Council vacancy is less than <br />one year from the date of �he occurrence of the vacancy, the <br />Council by a majority vate of all its remainzng members may <br />appoint a qualified person to fill the vacancy. Notice of the <br />vacancy, with a description setting for�h the minzmum set of <br />Z�gal qualifications io hold public office shali be posted at <br />City Hall and sent to the official city newspaper on the next <br />business day and sha1� include the following description of <br />the application and appointment process, whzch shall be followed <br />by the City Council: <br />1. Uniform appZications in a form approved by the City Council <br />must be received by the city manager no later than twenty-one <br />(21) days from the date of the occurrence of the vacancy. <br />Application forms submitted by the app�icants are public <br />documents. Applications shall request, at a minzmum, all <br />information required by Minnesota Statu�es for candidates <br />filing for the office. Additional information forms may be <br />adopte� by the City CounciZ and shall be required of each <br />applicant uniformly. The applican� may submit a resume, in <br />addition to the uniform applica�ion form. <br />2. Ten�ative intervzew schedulzng shall be comple�ed and <br />posted at City Hall no later than twenty-five (25) days from <br />the occurrence of the vacancy_ Applicants shall be responsible <br />�or requesting schedule changes. <br />
