A�tachment C <br />Excerpfs from the Ci#y of Shoreview Recycling <br />Con�ract — Residua�s Requi�ements <br />AGREEMENT FOR RECYCLJNG COLLECTION <br />This Agreement is made on the 1'` day of January 2001, between the CITY OF <br />SHQREVIEW, 4600 North Victoria Street, Shoreview, Minnesoia 55126 ("City") and <br />WASTE MANAGEMENT TNC., a Minnesota corporation, with its cnrrent local place <br />of business at 775 Rice Stzeet, St. Paul, Minnesota 5511'7 ("Contractor"). <br />4. DISP4SAL OF RECYCLABLES AND PROCESS RESIDUALS - <br />Contractor sha11 use its best efForts to assuxe that all recyclables <br />collected in the City are not placed in land%lls or incinerated and are <br />distributed to the appropniate markets for zeuse. The Contractor shali <br />dispose of no more than five (5) percent of material as proccss residuals <br />as waste residual as part of normal recyclable materials processing <br />operations. This process reject (residuals} amaunt shall be a maxi�urn <br />by weight as measured from total outgoing products shipped for the <br />anonth, and shatl be reported for any of the Conixactor's recyclables <br />processing facilities receiving material from the City. The Contractor <br />shall report actual percent process residuals disposed, and the disposal <br />facility or facilities utilizec� for disposal, with each monthly billing <br />statement. Tf the process residuals maximum is exceeded for any <br />facility for an.y month, ihe report shait include the types and amounts of <br />materials Iandfilled or incinerated, the reason for the landfilling or <br />incineration, and the sieps being taken by Contractor ta avoid land�ll <br />or incineration. <br />LACK OF ADEOUATE MARKF,T DEMAND - Zn thc event that the <br />maricet for a particulaz recyclable ceases to e�st, or becomes <br />economicalIy depressed that it becomes economzcally unfeasihle to <br />continue coliectian�processing and marketing of that particular <br />recyclable, the City and the Contractor wilZ botb� agree in w�riting that it <br />is no longer appropriate to collect such ite�n before collectian ceases_ <br />Contractor shall pay the costs of all disposa� of any item collccted that <br />is deemed not recyclable by Contractor and the City due to lack of <br />adequate market demaad. The City and Contractor shall specify a date <br />in the said written agreement to cease collection of the recyclable item <br />in questions. Contractoz shall at all times �e undex a duty to muumize <br />recyc]ables ending np in land�ill or incineration. If such disposal <br />becomes necessary, Contractor shall dispose o:f the materials at a <br />facilzty specified in writing by the City or an alternative agreed upon by <br />the City and the Contractor_ <br />7rzoros D�� <br />
