CITY RETAINS RIGHT TO SPECIFY RESLDENT PREPEIRATION <br />INSTRUCTIONS - Tlae Contractor agrees that it is the City's sole right <br />to clearly specify the resident sorting and set-out requuements. The <br />City shall publish and distribute, on an annual basis, the detailed <br />recyclables prepaz-ation instructions for its residents. However, it <br />agrees to confer with the Contractor prior to annual disiribution. <br />33_ LIQUIDATED DAMAGES - The Contractor agrees, in addition to any <br />other remedies available to the City, the City may withhold payment <br />from the Contractor in the amounts specified below as liquidated <br />darnages for failure of the Contractor to fulfill i#s obligations: <br />F. Failure to report on changes in location af recyclables <br />processing operations (as per Section 11 of the Agreement <br />body} - $250 per iz�cident. <br />G. Exceeding the maxiax�um process reject (residuals) rate (as per <br />Section � of the Agreement body) -$i,000 per exceedence <br />(defined as a monthly total by weight over the speci�ed <br />maximum rate). <br />H. Failure to receive City written approval of changes to the "Two- <br />Sort" collection/processing system prior to implexnenting any <br />such change (as speci�ed in Attachment A: Paragraph III.A.16) <br />- $5,000_ <br />I. Failure to conduct annual composition analysis {as specified in <br />Attachment A: Paragraphs III.A. I7 and III.B.18) -$100 per <br />incident. <br />Failure to provide written descriptiorz of the inearLS to estimate <br />relative axx�ount of process residuals derived from lhe City's <br />recyclables (as per AttachmenE A: Paragraphs III.A.18 and <br />III.B.19) - $100 per incident. <br />These amounts aze Jiquidated damages for losses suffered by the City, <br />and not a penalty. <br />2 DRpF'I' 7no�os <br />
