Regular City Council Meeting <br /> Monday,June 11,2012 <br /> Page 18 <br /> several areas that provided that information and the Police Department contact <br /> information for any training questions or clarification. <br /> Mayor Roe noted that when he and Councilmember Pust had served as a City <br /> Council subcommittee and recommended revisions to City Code several years <br /> ago, part of the licensing requirement included specifics related to verifying <br /> training as part of the license application process. <br /> Councilmember Johnson concurred, noting that within the last 24-36 months, a <br /> letter had been sent out by the Chief of Police to every manager, clearly outlin- <br /> ing this mandatory,not elective, training and the two-tiered penalty system. <br /> Councilmember Pust concurred with Councilmember Johnson. <br /> Mayor Roe, while recognizing that training opportunities may not have been <br /> taken advantage of, the annual reminder as pointed out by Lt. Rosand and other <br /> opportunities had been made available to all licenses. <br /> Pust moved, Johnson seconded, authorizing the Roseville Police Department to <br /> issue and administer the presumptive penalty as set forth in Section 302.15 of <br /> Roseville City Code for a $1,000 fine and a one (1) day suspension; and that <br /> Old Chicago Restaurant be fined an additional $1,000 for not complying with <br /> City Code requirements related to alcohol training. <br /> Councilmember Johnson questioned if the additional fine for training non- <br /> compliance should be acted upon tonight or at a future meeting, similar to the <br /> action for Smash Burger's violation. <br /> Councilmember Pust advised that the delay in dealing with Smash Burger's vio- <br /> lation was due to that being the first occurrence of that happening in Roseville <br /> under its City Code, and the need to review several issues prior to making a de- <br /> cision. However, Councilmember Pust noted that now the City Council had set <br /> a precedent and could confidently move forward with this action. <br /> Mayor Roe concurred, also noting that this was the second compliance check <br /> for Smash Burger, and since the violation was closer to the renewal period, <br /> there were additional due process and adequate notification issues that had been <br /> considered as well in that specific instance. <br /> Councilmember Johnson noted that these failures could also come under con- <br /> sideration in next year's renewals; with Mayor Roe concurring that they could <br /> be part of the City Council's consideration for renewal applications. <br /> Roll Call <br /> Ayes: Johnson; McGehee; Pust; Willmus; and Roe. <br />
