<br />Regular City Council Meeting <br />Minutes of <br />Monday, February 26, 2007 <br />Page 8 <br /> <br />points; potential signage for traffic flow; and lack of competition for traffic <br />with other tenants. <br /> <br />Applicants Amber Conradi and Paul Nelson <br />Ms. Conradi advised it was their intent to operate from 6:00 a.m. - 6:00 p.rn. <br /> <br />Further discussion included the minimum height of the fencing around the <br />playground at four feet and City restrictions at six feet; state licensure re- <br />quirements; commercial space versus residential space for childcare and dif- <br />ferent standards; type of material proposed for the playground (not bitumi- <br />nous); and the need for land use approval from the municipality prior to full <br />application to the state for licensing. <br />City Attorney Scott Anderson clarified the need to segregate personalities <br />(i.e., background investigations) from issues for a CUP approval for land <br />use. <br /> <br />Pust moved, Kough seconded, adoption of Resolution No. 10480 entitled, <br />"A Resolution Approving a Conditional use Pennit in Accordance with <br />Roseville City Code, SlOl3.0l, for BRIN, LLC at 2459 Rice Street (PF07- <br />004);" allowing for a child daycare center at the facility. <br /> <br />Substantial discussion was held, with Councilmember Ihlan expressing con- <br />cern regarding a CUP transferring with the property, and the City's lack of <br />ability to restrict hours if a new owner of the daycare chose to provide 24- <br />hour or late-night daycare services. Councilmember Ihlan suggested includ- <br />ing a condition that the daycare would only operate within a restricted time- <br />frame with a curfew or proposed deadline. <br /> <br />Councilmember Pust expressed concern with adding such a condition, opin- <br />ing that is was not the role of the City Council to establish or restrict busi- <br />ness needs of an enterprise not even up and running. <br /> <br />Ihlan moved, Kough seconded, an amendment to restrict closing time of the <br />daycare center to 8:00 p.rn. <br /> <br />Roll Call [Amendment] <br />Ayes: Kough and Ihlan. <br />Nays: Roe; Pust and Klausing. <br />
