<br />Regular City Couucil Meetiug <br />Monday, March 12, 2007 <br />Page 6 <br /> <br />Discussion included the actual calculations, as per City Code, for the exten- <br />sion deadline (March or September), with City Attorney Scott Anderson <br />opining that the extension would be from the January 28, 2007 preliminary <br />plat approval (thus July 28, 2007). <br /> <br />Councilmember Ihlan spoke in opposition to the extension; opining that the <br />drainage issues were addressed at the time of preliminary plat consideration, <br />and the applicant had been advised that these items were crucial to approval <br />and the City Council had been assured that they would be taken care of prior <br />to final plat approval, or the applicant would be required to re-apply. <br /> <br />Mayor Klausing suggested that it would have provided more positive func- <br />tioning of the City Council if Councilmember Ihlan had sought legal advice <br />from City Attorney Anderson prior to tonight's meeting. <br /> <br />Councilmember Ihlan reiterated her past arguments that the City Council <br />had given premature approval for this preliminary plat request of the appli- <br />cant. <br /> <br />City Attorney Anderson concurred with staff that it was not unusual for an <br />applicant to seek an extension for required work to be completed between <br />the preliminary and final plat approvals. <br /> <br />Mayor Klausing, citing his experience on the City Council and Planning <br />Commission, noted that, as a common courtesy, unless evident prejudice to <br />the interests of the citizens or City in doing so, it was normal to grant an ex- <br />tension when requested by an applicant. <br /> <br />Councilmember Ihlan sought public comment; however, no one appeared. <br /> <br />Klausing moved, Pust seconded, approval of an extension of City Code, Sec- <br />tion 1102.01F (Final Plat - Final Plat Submission) for Art Mueller, 2201 <br />Acorn Road (PF 3791), until July 28, 2007. <br /> <br />Roll Call <br />Ayes: Pust; Roe and Klausing. <br />Nays: Ihlan. <br />
