<br />Regular City Council Meeting <br />Monday, March 26, 2007 <br />Page 23 <br /> <br />CUP application, a condition of approval was an enclosure, along with the <br />commitment of Starbucks to control and monitor the site to address <br />neighborhood concerns. <br /> <br />Loren Hohman, Kimco Realty representative <br />Mr. Hohman addressed the previous difficulties in the process for achieving <br />successful development of the site, while attracting other upscale businesses; <br />and opined that this tenant would provide a great improvement aesthetically <br />and tenant-wise for the location. Mr. Hohman provided a development per- <br />spective on the different markets interpreted by Starbucks between the two <br />sites, on the north and proposed south side of Highway 36 and the natural <br />barrier created by Highway 36 and potential to eliminate some congestion, <br />with quick movement through the drive-thru anticipated as people are stop- <br />ping on their way to work. Mr. Hohman noted that with such an upscale <br />business operation as represented by Starbucks, 65-70% of their business <br />was done before 10:00 a.m. Mr. Hohman opined that Starbucks didn't need <br />to market or promote their business, as the site would be absorbing traffic <br />that was already there. <br /> <br />Brad Peper, 1835 Gluek Lane <br />Mr. Peper addressed his concerns expressed at a previous meeting regarding <br />traffic flow on site and coming back onto Fairview Avenue to proceed north, <br />and potential impacts to his property on the west side of Fairview with head- <br />lights. Mr. Peper noted the gap in the existing evergreens that could create <br />additional light pollution in his home. Mr. Peper referenced discussions <br />with the applicant after the February meeting, and Rice Creek Watershed <br />pressures on the applicant to remove and! or clean up that vegetation, and <br />Mr. Peper's preference that it remain, or be replaced to better screen the <br />headlights from the bedroom windows in his home. <br /> <br />Mayor Klausing thanked everyone, and closed public comment at this time <br />for further City Council deliberation. <br /> <br />Mayor Klausing opined his rationale for supporting approval of the CUP, <br />given the lack of criteria or findings that were specific to the CUP request <br />(i.e., drive-thru) and his not being persuaded by arguments presented that <br />there was a significant impact on the health, safety or welfare of the com- <br />munity related to the specific nature of the drive-thru.
