EXTRACT OF MINUTES OF MEETING OF THE CITY COUNCIL OF THE CITY OF ROSEVILLE Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Roseville, County of Ramsey, Minnesota, was held on the 26th day of February, 2007, at 6:00 p.m. The following members were present: Kough, Ihlan, Roe, Pust, and Klausing and none were absent: Council Member Pust introduced the following resolution and moved its adoption: RESOLUTION NO. 10480 A RESOLUTION APPROVING A CONDITIONAL USE PERMIT IN ACCORDANCE WITH ~1013.01 OF THE ROSEVILLE CITY CODE FOR BHJN, LLC AT 2459 RICE STREET (PF07-004) WHEREAS, ACR Homes, the parent company ofBHJN, LLC, is the owner of property at 2459 Rice Street; and WHEREAS, the subject property is legally described as: SECTION 12 TOWNSHIP 29 RANGE 23 TRANSIT SECOND ADDITION SUBECT TO DRIVE EASEMENT LOTS 1 & 2, BLOCK 1 PIN: 12-29-23-14-0089 WHEREAS, the property owner seeks to operate a child daycare on property zoned B-2, Retail Business District; and WHEREAS, the proposed child daycare is a conditionally-permitted use in the B-2, Retail Business District; and WHEREAS, The Roseville Planning Commission held a public hearing regarding the requested CONDITIONAL USE PERMIT, voting 6-0 to recommend approval of the request based on the comments and findings of the staff report dated February 7,2007; and WHEREAS, the Roseville City Council has determined that approval of the requested CONDITIONAL USE PERMIT will not adversely affect conditions on nearby properties and will not compromise the health, safety, and general welfare of the citizens of Rose vi lIe; NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to APPROVE the request by BHJN, LLC for a CONDITIONAL USE PERMIT in accordance with Section 91013.01 of the Roseville City Code, subj ect to the following conditions; 1.
