<br />EXTRACT OF MINUTES OF MEETING OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br /> <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />Roseville, County of Ramsey, Minnesota, was held on the 26th day of February, 2007, at 6:00 <br />p.m. <br /> <br />The following members were present: Kough, Ihlan, Roe, Pust, and Klausing <br /> <br />and none were absent: <br /> <br />Council Member Pust introduced the following resolution and moved its adoption: <br /> <br />RESOLUTION NO. 10480 <br />A RESOLUTION APPROVING A CONDITIONAL USE PERMIT IN ACCORDANCE <br />WITH ~1013.01 OF THE ROSEVILLE CITY CODE FOR BHJN, LLC AT 2459 RICE <br />STREET (PF07-004) <br /> <br />WHEREAS, ACR Homes, the parent company ofBHJN, LLC, is the owner of property <br />at 2459 Rice Street; and <br /> <br />WHEREAS, the subject property is legally described as: <br /> <br />SECTION 12 TOWNSHIP 29 RANGE 23 TRANSIT SECOND ADDITION SUBECT TO <br />DRIVE EASEMENT LOTS 1 & 2, BLOCK 1 <br />PIN: 12-29-23-14-0089 <br /> <br />WHEREAS, the property owner seeks to operate a child daycare on property zoned B-2, <br />Retail Business District; and <br /> <br />WHEREAS, the proposed child daycare is a conditionally-permitted use in the B-2, <br />Retail Business District; and <br /> <br />WHEREAS, The Roseville Planning Commission held a public hearing regarding the <br />requested CONDITIONAL USE PERMIT, voting 6-0 to recommend approval of the request <br />based on the comments and findings of the staff report dated February 7,2007; and <br /> <br />WHEREAS, the Roseville City Council has determined that approval of the requested <br />CONDITIONAL USE PERMIT will not adversely affect conditions on nearby properties and <br />will not compromise the health, safety, and general welfare of the citizens of Rose vi lIe; <br /> <br />NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to APPROVE <br />the request by BHJN, LLC for a CONDITIONAL USE PERMIT in accordance with Section <br />91013.01 of the Roseville City Code, subj ect to the following conditions; <br /> <br />1. The size/scale of the play structure in the playground area must be approved by <br /> <br />1 <br />
