<br />EXTRACT OF MINUTES OF MEETING OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br /> <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />Roseville, County of Ramsey, Minnesota, was held on the 26th day of February, 2007, at 6:00 <br />p.nl. <br /> <br />The following members were present: Kough, Ihlan, Roe, Pust, and Klausing; <br /> <br />and none were absent. <br /> <br />Council Member Ihlan introduced the following resolution and moved its adoption: <br /> <br />RESOLUTION NO. 10481 <br />A RESOLUTION DENYING A VARIANCE TO ~1016.16 AND IN ACCORDANCE <br />WITH ~1013.02 OF THE ROSEVILLE CITY CODE FOR THOMAS MCDANIEL AT <br />527 OW ASSO IDLLS DRIVE (PF3787) <br /> <br />WHEREAS, Thomas McDaniel is the owner of property at 527 Owasso Hills Drive; and <br /> <br />WHEREAS, the subject property is legally described as: <br /> <br />OWASSO IDLLS LOT 10, BLOCK 1 <br />PIN: 01-29-23-32-0026 <br /> <br />WHEREAS, the property owner seeks a 15 foot VARIANCE to S1016.16 (Wetland <br />Setbacks) to allow principal structure encroachment into the required wetland setback; and <br /> <br />WHEREAS, The Roseville Variance Board held a public hearing regarding the requested <br />VARIANCE, voting 3.,.0 to DENY based on their determination that "hardships" were not <br />present; and <br /> <br />WHEREAS, the applicant has appealed the decision of the Variance Board to the <br />Roseville City Council, pursuant to S 1 013.02 of the City Code, seeking the Council's support for <br />the requested IS-foot setback VARIANCE; <br /> <br />WHEREAS, the Roseville City Council concurs with the resolution passed by the <br />Variance Board, determining the following finding of fact: <br /> <br />WHEREAS, Section 1016.16 requires a minimum 50-foot setback for principal <br />residential structures from wetland boundaries; and <br /> <br />WHEREAS, Thomas McDaniel seeks to expand the principal residential structure to <br />encroach into the required \vetland setback; and <br /> <br />1 <br />
