<br />Regular City Council Meeting <br />Monday, May 07, 2007 <br />Page 10 <br /> <br />Discussion included differences in the Planned Unit Development <br />(PUD) process between the Cities of Arden Hills and Roseville; the <br />EA W process not differentiating municipal boundaries and consider- <br />ing the entire development; citizen petition (25 signatories) poten- <br />tially requesting an EA W if not requested by a municipality; traffic <br />concerns on Lydia; ingress/egress on the north side of the campus on <br />the Arden Hills side in consideration of additional dormitories; miti- <br />gation issues in consideration of water runoff and traffic concerns. <br /> <br />City Attorney Anderson reviewed the time table and process related to <br />consideration of the land use application; and the EA W process and <br />publication requirements. <br /> <br />Mr. Stark noted that staff was already in the process of working on the <br />Environmental Assessment Worksheet (EA W) preparing it for sub- <br />mission to the applicable agencies; and would return to the City <br />Council for formal action. ' <br /> <br />City Attorney Anderson concurred with staff that the law was very <br />specific regarding environmental review; and provided, as a Bench <br />Handout, a copy of the MN Rules, Chapter 4410, for the City Council <br />to reference during and at the end of the process. <br /> <br />Further discussion included whether formal action was applicable and <br />what specific direction would be provided to staff; delegation by the <br />City Council to their technical staff; and maintaining City Council <br />oversight of the RGU designation without micromanaging staff. <br /> <br />No action taken. The City Council, by consensus, concurred that staff <br />and the City Council would fill their appropriate and specific roles in <br />accepting the designation as the Responsible Governmental Unit <br />(RGU) for the Northwestern College EA W. <br /> <br />b. Status Report - Status of Axel's Charhouse Alcohol Violation <br />Appeal Proceedings and Recommendation for Action <br />City Attorney Anderson reviewed the proposed settlement with Axel's <br />Charhouse, due to their asserted claim for violation of due process in <br />the City shutting them down due to past liquor license violation in <br />selling to minors, and doing so prior to their appeal hearing being <br />heard.
