<br />Regular City Council Meeting <br />Monday, May 07, 2007 <br />Page 9 <br /> <br />City Attorney Anderson advised that the Wetland Conservation Act <br />(WCA), Minnesota Rules, part 8420.90122, subpart 5 (incidental crea- <br />tion), addressed 10 categories of exempt drain and fill activities, re- <br />quiring that exempt activities receive a permit from the City Council. <br />Mr. Anderson noted that a Technical Evaluation Panel (TEP) re- <br />viewed the applications and came up with the findings of the Wetland <br />Act. Mr. Anderson further advised that the Council was asked, in ac- <br />cordance with Section 1016.25 of the Code, to issue a Fill Permit, not <br />to review findings of the Wetland Act. Mr. Anderson advised that he <br />had requested a copy of the application; exemption certificate and <br />findings of fact, and found them to look appropriate and in order. <br /> <br />Klausing moved, Ihlan seconded, approval of the 2986 W. Owasso <br />Boulevard application to fill pursuant to City Code. <br /> <br />Councilmember Ihlan specified that, for the record, she was basing <br />her support of the motion on the findings of the TEP, that they were <br />appropriate under that specific provision. <br /> <br />Councilmember Kough sought assurance that the type of fill matt;:rials <br />would be appropriate; with Ms. Bloom assuring him that they would <br />be of a suitable material. <br /> <br />Roll Call <br />Ayes: Roe; Kough; Ihlan; Pust and Klausing. <br />Nays: None. <br /> <br />9. Responsible Government Unit (RGU) - Consider a request by the <br />Roseville Community Development Department for the City of <br />Roseville to act as the RGU in the Northwestern College Envi- <br />ronmental Assessment Worksheet (PF 07-002) <br />Community Development Director John Stark outlined the additional <br />comments provided and outlined in the staff report dated May 7, <br />2007, addressing questions and comments of the City Council at their <br />previous meeting. <br />
