Encroachment Agreement - Approve an Encroachment Agree- <br />ment for Walser Dealership (Former Consent Item 7.f) <br />City Engineer Deb Bloom reviewed the request for approval of the <br />agreement, based on review and approval of the City Attorney's of- <br />fice. <br /> <br />Councilmember Ihlan questioned the indemnification agreement lan- <br />guage in Section 3, and lack of language addressing potential flooding <br />and City-related concerns. <br /> <br />City Attorney Anderson concurred that the document should be re- <br />viewed once again. <br /> <br />Klausing moved, Ihlan seconded, TABLING approval of an En- <br />croachment Agreement between the City of Roseville and Jason W. <br />McCarthy (Owner), pending completion of revisions and/or renegotia- <br />tions. <br /> <br />Roll Call <br />Ayes: Roe; Kough; Ihlan; Pust and Klausing. <br />Nays: None. <br /> <br />Mayor Klausing reiterated his previous request that Councilmembers alert staff <br />with their questions prior to the Council meeting to facilitate quicker meeting <br />times. <br /> <br />g. Wetland Permit - Approve a Wetland Permit Application at 2986 <br />W. Owasso Boulevard (former Consent Item 7.g) <br />Councilmember Ihlan questioned the status of the wetland, and in <br />which specific law it was contained. <br /> <br />Ms. Bloom noted that this Chapter, as detailed in the staff report dated <br />May 7, 2007, provided property owners protection when they inadver- <br />tently created wetlands. Ms. Bloom noted that this particular area had <br />now taken on wetland characteristics, but was exempt under the pro- <br />visions in the state law. <br />
