Roseville Properties <br />200 South Sixth Street 2575 Fairview Avenue North <br />Suite 4000 Suite 250 <br />Minneapolis, MN 55402Roseville, MN 55113 <br />RE: Request for Zoning Compliance of Retail Use in the Community Mixed-Use District <br />Dear Ms. Steinwall and Mr. Rancone: <br />The Roseville Community Development Department has received and reviewed your request <br />dated June 8, 2012 for a zoning use determination for the proposed Wal-Mart store to be <br />generally located at County Road C and Cleveland Avenue, and within the Twin Lakes <br />Redevelopment Area. <br />As a point of reference, when the Community Development Department begins initial <br />discussions with a prospective developer, we employ a professional understanding of the zoning <br />ordinance (which was adopted to be consistent with the 2030 Comprehensive Plan) to determine <br />whether a use is permitted, conditional or prohibited for a given zoning district. If necessary, the <br />Department also reviews other important documents to determine whether additional information <br />will need to be provided to City Staff to determine other necessary and/or required <br />improvements. <br />As you know, when the potential Wal-Mart store was brought to City Staff’s attention in 2011, <br />staff followed its typical procedure and reviewed the proposed use with the zoning ordinance and <br />verbally confirmed that the proposed Wal-Mart store was permitted in the Community Mixed <br />Use Zoning District, subject to complying with zoning regulations. <br />However, there continues to be community concern regarding the use and size of the proposed <br />Wal-Mart which has led us to provide you with a more detailed analysis of all documents that <br />may have some authority over the Twin Lakes Redevelopment Area. These include:the 2030 <br />Roseville Comprehensive Plan, Title 10 Zoning Ordinance, Twin Lakes Business Park Master <br />Plan, Twin Lakes Urban Design Principles, Twin Lakes AUAR, and the Minnesota Court of <br />Appeals decision of 2006, File # C3-05-44. This review and analysis however, is limited to the <br />use and does not address site improvement or building design compliance with the zoning <br />ordinance. <br />S <br />UMMARY <br />The Community Development Department finds that a retail development of 160,000 sq. ft. <br />within the Twin Lakes Redevelopment Area (the Wal-Mart project) is under the thresholds of the <br />Twin Lakes AUAR, is not prohibited by the 2001 Twin Lakes Business Park Master Plan nor the <br />2030 Roseville Comprehensive Plan, and is permitted by the Roseville Zoning Ordinance. <br />Page1of27 <br /> <br />
