AttachmentD <br />The following is our detailed analysis of the proposed Wal-Mart project. <br />I.ZC <br />ONINGODE <br />The Wal-Mart project is proposed to be located on property within the Community Mixed Use <br />Zoning District (CMU). Regulations covering development within the CMU district are <br />generally contained in Chapter 1005 (Commercial and Mixed Use Districts) and specifically <br />within Chapter 1005.07 (Community Mixed Use District). <br />1.) <br />The Community Development Department finds that the Statement of Purpose within <br />Section 1005.01 of the zoning ordinance allows for the Wal-Mart project since it does not <br />include any prohibitions or limitations regarding use or size, and that the purpose statement is <br />merely a guide for future development. Words like “promote”, “provide”, “improve”, and <br />“encourage”, individually or collectively, do not limit a specific use, nor do they require <br />something. On the contrary, these words provide general direction and guidance for the <br />requirements that follow later in the zoning ordinance. <br />ZO <br />ONINGRDINANCE <br />CM-UD <br />OMMERCIAL AND IXEDSEISTRICTS <br />1005.01 Statement of Purpose <br />The commercial and mixed-use district is designed to: <br />A.Promote an appropriate mix of commercial development types within the <br />community; <br />B.Provide attractive, inviting, high-quality retail shopping and service areas that <br />are conveniently and safely accessible by multiple travel modes including transit, <br />walking, and bicycling; <br />C.Improve the community’s mix of land uses by encouraging mixed medium- and <br />high-density residential uses with high quality commercial and employment uses <br />in designated areas; <br />D.Encourage appropriate transitions between higher-intensity uses within <br />commercial and mixed use centers and adjacent lower-density residential <br />districts; and <br />E.Encourage sustainable design practices that apply to buildings, private <br />development sites, and the public realm in order to enhance the natural <br />environment. <br />2 <br />Page2of27 <br /> <br />
