instance, the zoning code neither defines the use nor offers any regulations that help to <br />59 <br />explain why office-based classes are treated differently than other office uses in a zoning <br />60 <br />district designed for exactly that. <br />61 <br />5.3To address these kinds of changes in the zoning code, Planning Division staff is <br />62 <br />proposing to make the following general amendments: <br />63 <br />a. <br />Add a second definition for colleges/post-secondary schools to clarify the distinction <br />64 <br />between campuses and office settings; <br />65 <br />b. <br />Add the office-based educational facility as a permitted use in the CB District, and as <br />66 <br />permitted uses with heightened screening requirements in the NB District; and <br />67 <br />c. <br />Replace the “school of business or trades” use in the O/BP District with the office- <br />68 <br />based academic use and allow it as a permitted use rather than as a conditional use. <br />69 <br />The full, proposed amendment in draft ordinance form is included with this report as <br />70 <br />bold <br />Attachment B, and is shown in and strikethrough text. Please note that Attachment <br />71 <br />B omits large portions of the zoning code and only includes those portions which are <br />72 <br />subject to the proposed amendment, along with selected content to provide additional <br />73 <br />context surrounding the proposed changes; nothing is proposed to be added or deleted <br />74 <br />from the zoning code which is not explicitly shown. <br />75 <br />6.0PC <br />UBLICOMMENT <br />76 <br />6.1As of the time this report was prepared, Planning Division staff has received one phone <br />77 <br />call about the proposed , and the same subjects of the phone <br />ZONING TEXT AMENDMENT <br />78 <br />call were discussed in detail at the duly-noticed public hearing held by the Planning <br />79 <br />Commission on June 6, 2012; draft minutes of the public hearing are included with this <br />80 <br />staff report as Attachment A. <br />81 <br />6.2Several questions pertaining to the 2030 Comprehensive Plan were raised at the public <br />82 <br />hearing, but not all of them were answered at the time. One outstanding question was <br />83 <br />whether 2803 Lincoln Drive, a property with a CB land use designation, conforms to the <br />84 <br />Comprehensive Plan’s description of CB properties being located on streets classified in <br />85 <br />the Transportation Plan as “A Minor Augmenter” or “A Minor Reliever;” neither Lincoln <br />86 <br />Drive nor Terrace Drive is classified as such in the Transportation chapter of the <br />87 <br />Comprehensive Plan. In fact, many streets circulating through CB-designated areas are <br />88 <br />not minor-arterial-class streets—many of the streets in these commercial areas are local <br />89 <br />streets. This is not a violation of the Comprehensive Plan. Instead, it a reflection of the <br />90 <br />fact that the minor arterial classification designates metropolitan-level roadways that <br />91 <br />augment the network of principal arterials and relieve overflow traffic rather than <br />92 <br />denoting streets with the minimum qualifications for handling commercial traffic. <br />93 <br />Planning Division staff believes that the Comprehensive Plan promotes locating CB- <br />94 <br />designated properties on the A Minor Augmenter and Reliever streets in order to <br />95 <br />minimize commercial traffic on local residential streets rather than minimizing traffic on <br />96 <br />localcommercial streets like Lincoln and Terrace Drives in that location. <br />97 <br />6.3The question also seems to linger as to whether teaching, be it in a conventional school <br />98 <br />setting or in an office setting, is an “institutional” activity to be limited to areas guided by <br />99 <br />the Comprehensive Plan for Institutional land uses. Music and dance studios, martial arts <br />100 <br />dojos, tutoring centers, and the like are places where teaching and learning take place, <br />101 <br />and which are often located in commercial-type properties.
