Attachment A <br />NOW BE IT RESOLVED by the Board of Adjustment and Appeals of the City of <br />39 <br />Roseville, Minnesota, hereby memorializes its conclusion of law and findings of fact as follows: <br />40 <br />41 <br />Conclusion of Law <br />42 <br />43 <br />The proposed retail and grocery store at a parcel of land to be platted as Lot 1, Block 1, Twin <br />44 <br />nd <br />Lakes 2 Addition is a permitted use under the City’s Zoning Code. <br />45 <br />46 <br />Findings of Fact <br />47 <br />48 <br />1.The proposed land use conforms to the Statement of Purpose contained within Section <br />49 <br />1005.01 of the Zoning Code. <br />50 <br />2.The proposed land use conforms to descriptions of permitted uses contained within the <br />51 <br />Use Chart relevant to a Community Mixed Use District under the Zoning Code. <br />52 <br />3.The proposed land use conforms to the Statement of Purpose for Community Mixed Use <br />53 <br />Districts under the Zoning Code. <br />54 <br />4.As it is applied to the proposed land use at issue, no conflict exists between the Zoning <br />55 <br />Code and the Comprehensive Plan. <br />56 <br />5.The proposed land use nevertheless conforms to the City’s Comprehensive Plan as it <br />57 <br />relates to Community Mixed Use designations. <br />58 <br />6.The proposed land use conforms to the Community Business designation as it relates to <br />59 <br />uses within a Community Mixed Use designation. <br />60 <br />7.The proposed land use conforms to other official controls, guiding documents, and <br />61 <br />environmental studies such as the Twin Lakes Sub-Area 1 Regulating Plan, the Twin <br />62 <br />Lakes Business Park Master Plan, and the Alternative Urban Areawide Review. <br />63 <br />8.The analysis performed by the Community Development Department as contained within <br />64 <br />its administrative zoning decision is generally adopted as proper and prudent as it relates <br />65 <br />to these Findings of Fact. <br />66 <br />67 <br />The motion for the adoption of the foregoing resolution was duly seconded by Board <br />68 <br />Member _________________ and upon vote being taken thereon, the following voted in favor: <br />69 <br />and ______________ voted against. <br />70 <br />WHEREUPON said resolution was declared duly passed and adopted. <br />71 <br />72 <br /> <br />
